PAG LIN 1 1 HOUSE CONCURRENT RESOLUTION NO. ___ 1 2 BY (PROPOSED COMMITTEE ON TECHNOLOGY RESOLUTION 1 3 BY CHAIRPERSON BRUNKHORST) 1 4 A Concurrent Resolution relating to the request for 1 5 proposals for Part III of the Iowa communications network 1 6 and requesting the Iowa telecommunications and technology 1 7 commission to issue a notice of intent to award and 1 8 begin negotiations with the qualifying vendors. 1 9 WHEREAS, the Iowa telecommunications and technology 1 10 commission has delivered to the General Assembly a written 1 11 report and all proposals submitted in response to the request 1 12 for proposals for Part III of the Iowa communications network 1 13 as required under section 8D.3, subsection 3, paragraph "e", 1 14 subparagraph (3); and 1 15 WHEREAS, the commission has identified the low bids 1 16 submitted on a site-by-site basis and on a merged area basis; 1 17 and 1 18 WHEREAS, the General Assembly has determined that further 1 19 discussions with vendors submitting the low bids are necessary 1 20 to determine what action should be taken with respect to the 1 21 connection of additional authorized users identified in the 1 22 request for proposals; and 1 23 WHEREAS, the General Assembly has determined that the these 1 24 discussions cannot occur under the bidding process implemented 1 25 by the commission without further direction from the General 1 26 Assembly; NOW THEREFORE, 1 27 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE SENATE 1 28 CONCURRING, That the Iowa telecommunications and technology 1 29 commission is requested to issue a notice of intent to award 1 30 to the low site-by-site bidders and low merged area bidders as 1 31 determined by the bids submitted in response to the request 1 32 for proposals for Part III of the Iowa communications network, 1 33 and begin evaluations and negotiations for establishing final 1 34 terms of a proposed agreement or agreements with such bidders 1 35 consistent with chapter 8D, state bidding procedures, and the 2 1 terms of the request for proposals; and 2 2 BE IT FURTHER RESOLVED, That the evaluations and 2 3 negotiations authorized by this resolution and any proposed 2 4 agreement resulting from the evaluations and negotiations are 2 5 in no way binding on the commission or the state until such 2 6 time as the provisions of section 8D.3, subsection 3, 2 7 paragraph "e", subparagraph (3), have been completely 2 8 satisfied and authorization by a constitutional majority of 2 9 each house of the General Assembly and approval by the 2 10 Governor has been given to enter into an agreement with a 2 11 selected bidder or bidders; and 2 12 BE IT FURTHER RESOLVED, That this Resolution is not 2 13 intended to modify the state's reservation of the right to 2 14 reject any or all bids after completion by the commission of 2 15 the evaluations and negotiations authorized by this 2 16 Resolution; and 2 17 BE IT FURTHER RESOLVED, That a copy of this Resolution be 2 18 included in each notice of intent to award issued by the 2 19 commission. 2 20 LSB 1889HC 76 2 21 mj/cf/24
