PAG LIN 1 1 Section 1. Section 22.7, subsection 10, Code 1995, is 1 2 amended by striking the subsection. 1 3 Sec. 2. Section 22.7, subsection 11, Code 1995, is amended 1 4 to read as follows: 1 5 11. Personal information in confidential personnel and 1 6 payroll records ofpublic bodies including but not limited to1 7cities, boards of supervisors and school districtsofficials, 1 8 officers, or employees of a government body. However, the 1 9 following information pertaining to officials, officers, or 1 10 employees which may be contained in confidential personnel and 1 11 payroll records shall not be kept confidential: 1 12 a. The name and compensation of the individual. 1 13 b. The date the individual was employed by the government 1 14 body. 1 15 c. The positions the individual holds or has held with the 1 16 government body. 1 17 d. The individual's basic general qualifications for the 1 18 position the individual holds or has held, such as educational 1 19 background, and work experience. 1 20 e. Information concerning the following if the public's 1 21 interest in access outweighs the individual's interest in 1 22 confidentiality: 1 23 (1) Sick leave taken. 1 24 (2) Any disciplinary action taken against an individual 1 25 which resulted in the individual's discharge. 1 26 f. Other information as to which the public's interest in 1 27 access outweighs the individual's interest in confidentiality. 1 28 EXPLANATION 1 29 This bill alters the exceptions to the public records 1 30 chapter pertaining to employee records. The bill strikes the 1 31 provision pertaining to personal information in confidential 1 32 records of the military division of the department of public 1 33 defense. 1 34 The bill also changes the exception pertaining to personnel 1 35 records of other government employees. Under the bill certain 2 1 information in confidential personnel and payroll records of 2 2 officials, officers, or employees of a government body shall 2 3 not be confidential. This information includes the following 2 4 items concerning employees' names and compensation; date of 2 5 employment; positions held with the government body; basic 2 6 qualifications, educational background, and work experience; 2 7 information concerning sick leave taken and disciplinary 2 8 actions, if the public's interest in access outweighs the 2 9 individual's interest in confidentiality; and other 2 10 information as to which the public's interest in access 2 11 outweighs the individual's interest in confidentiality. 2 12 BACKGROUND STATEMENT 2 13 SUBMITTED BY THE AGENCY 2 14 These changes are intended to enhance government's 2 15 accountability to its citizenry. Under present law when a 2 16 complaint is made about a government action or inaction and it 2 17 is determined that a government employee erred or misbehaved, 2 18 most remedial actions responding to that error or behavior are 2 19 shielded from public scrutiny because it is deemed personal 2 20 personnel information. The public has an interest in knowing 2 21 how its government responds to erroneous, negligent, wrongful, 2 22 and inappropriate actions, decisions, and behavior of its 2 23 officials and employees. Public scrutiny of these responses 2 24 would enhance government responsibility, accountability, and 2 25 responsiveness. 2 26 LSB 1135DP 76 2 27 cl/jj/8
