  1  1    Section 1.  The following amendment to the Constitution of
  1  2 the State of Iowa is proposed:
  1  3    1.  Section 16 of Article III of the Constitution of the
  1  4 State of Iowa, as amended by amendment number 4 of the Amend-
  1  5 ments of 1968, is repealed and the following adopted in lieu
  1  6 thereof:
  1  7    EXECUTIVE APPROVAL &endash; VETO &endash; ITEM VETO BY GOVERNOR.  Sec.
  1  8 16.  Every bill which shall have passed the General Assembly,
  1  9 shall, before it becomes a law, be presented to the Governor.
  1 10 If the Governor approves, the Governor shall sign it; but if
  1 11 not, the Governor shall return it with the Governor's
  1 12 objections, to the house in which it originated, which shall
  1 13 enter the same upon their journal, and proceed to reconsider
  1 14 it; if, after such reconsideration, it again passes both
  1 15 houses, by yeas and nays, by a majority of two thirds of the
  1 16 members of each house, it shall become a law, notwithstanding
  1 17 the Governor's objections.  If any bill shall not be returned
  1 18 within three days after it shall have been presented to the
  1 19 Governor, Sunday excepted, the same shall be a law in like
  1 20 manner as if the Governor had signed it, unless the General
  1 21 Assembly, by adjournment, prevent such return.  Any bill
  1 22 submitted to the Governor for approval during the last three
  1 23 days of a session of the General Assembly, shall be deposited
  1 24 by the Governor in the office of Auditor of State, within
  1 25 thirty days after the adjournment, with the Governor's
  1 26 approval, if approved by the Governor, and with the Governor's
  1 27 objections, if the Governor disapproves thereof.
  1 28    The Governor may approve appropriation bills in whole or in
  1 29 part, and may disapprove any item of an appropriation bill;
  1 30 and the part approved shall become a law.  Any item of an
  1 31 appropriation bill disapproved by the Governor shall be
  1 32 returned, with the Governor's objections, to the house in
  1 33 which it originated, or shall be deposited by the Governor in
  1 34 a state office, which office shall be designated by law, in
  1 35 the case of an appropriation bill submitted to the Governor
  2  1 for the Governor's approval during the last three days of a
  2  2 session of the General Assembly, and the procedure in each
  2  3 case shall be the same as provided for other bills.  Any such
  2  4 item of an appropriation bill may be enacted into law
  2  5 notwithstanding the Governor's objections, in the same manner
  2  6 as provided for other bills.
  2  7    2.  Section 21 of Article IV of the Constitution of the
  2  8 State of Iowa is repealed and the following adopted in lieu
  2  9 thereof:
  2 10    GRANTS AND COMMISSIONS.  Sec. 21.  All grants and
  2 11 commissions shall be in the name and by the authority of the
  2 12 people of the State of Iowa, sealed with the Great Seal of the
  2 13 State, signed by the Governor, and countersigned by the
  2 14 Auditor of State.
  2 15    3.  Section 22 of Article IV of the Constitution of the
  2 16 State of Iowa, as amended by amendment number 1 of the
  2 17 Amendments of 1972, is repealed and the following adopted in
  2 18 lieu thereof:
  2 19    AUDITOR &endash; TREASURER.  Sec. 22.  An Auditor of State and a
  2 20 Treasurer of State shall be elected by the qualified electors
  2 21 at the same time that the Governor is elected and for a four-
  2 22 year term commencing on the first day of January next after
  2 23 their election.  The Auditor of State shall conduct all lawful
  2 24 elections held in the state and shall receive for filing all
  2 25 documents required by law for the organization and creation of
  2 26 corporations.  The Auditor of State and Treasurer of State
  2 27 shall perform other duties as may be provided by law.
  2 28    Sec. 2.  The foregoing proposed amendment to the Constitu-
  2 29 tion of the State of Iowa is referred to the General Assembly
  2 30 to be chosen at the next general election for members of the
  2 31 General Assembly and the Secretary of State is directed to
  2 32 cause it to be published for three consecutive months previous
  2 33 to the date of that election as provided by law.  
  2 34                           EXPLANATION
  2 35    This proposed amendment to the Constitution of the State of
  3  1 Iowa removes the office of secretary of state from the
  3  2 Constitution and provides that the auditor of state shall
  3  3 perform the constitutional duties of the secretary of state.
  3  4    The joint resolution also provides that the auditor of
  3  5 state shall conduct elections and receive corporate filings
  3  6 and perform other duties as required by law.  Currently, the
  3  7 secretary of state is required by statute to conduct elections
  3  8 and receive corporate filings.
  3  9    The resolution, if adopted, would be referred to the next
  3 10 general assembly before being submitted to the electorate for
  3 11 ratification.
