PAG LIN 1 1 Section 1. The following amendment to the Constitution of 1 2 the State of Iowa is proposed: 1 3 1. Article XI of the Constitution of the State of Iowa is 1 4 amended by adding the following new section: 1 5 RECALL OF ELECTIVE STATE OFFICERS. Sec. 9. All elective 1 6 state officers, members of the General Assembly, and all 1 7 elective officials of political subdivisions of the State 1 8 shall be subject to recall from office by the eligible 1 9 electors of the State or political subdivisions whenever a 1 10 petition demanding recall signed by eligible electors equal in 1 11 number to at least twenty-five percent of the votes cast for 1 12 that office in the last election is filed with the official 1 13 with whom nomination papers for the office are filed, and such 1 14 official shall call a special election on the recall of the 1 15 officer in accordance with a procedure established in law by 1 16 the General Assembly. 1 17 Sec. 2. The foregoing amendment to the Constitution of the 1 18 State of Iowa is referred to the General Assembly to be chosen 1 19 at the next general election for members of the General 1 20 Assembly and the Secretary of State is directed to cause the 1 21 same to be published for three consecutive months previous to 1 22 the date of that election as provided by law. 1 23 EXPLANATION 1 24 This joint resolution proposes an amendment to the 1 25 Constitution of the State of Iowa which would allow an 1 26 election for the recall from office of the governor, 1 27 lieutenant governor, secretary of state, auditor of state, 1 28 treasurer of state, attorney general, secretary of 1 29 agriculture, members of the general assembly, and elective 1 30 officials of political subdivisions after petition by the 1 31 eligible electors of the state or of the political 1 32 subdivisions. Implementation of the amendment would require 1 33 statutory changes. 1 34 The resolution, if adopted, would be referred to the next 1 35 general assembly before being submitted to the electorate for 2 1 ratification. 2 2 LSB 1951HH 76 2 3 sc/sc/14
