1 1 Section 1. NEW SECTION. 15A.4 CONTROLLED SUBSTANCE
1 2 OFFENSE – REPAYMENT OF ASSISTANCE RECEIVED BY BUSINESS.
1 3 A business which receives economic development assistance
1 4 shall enter into an agreement with the governmental entity
1 5 providing the assistance providing that the business shall
1 6 repay the assistance received by the business if one of the
1 7 following individuals is convicted of a violation of chapter
1 8 124 committed during the period in which the agreement is in
1 9 effect, which shall not be less than one year:
1 10 1. The owner, if the business is a sole proprietorship.
1 11 2. A partner or managing partner, if the business is a
1 12 partnership or limited partnership.
1 13 3. A member of a limited liability company with management
1 14 responsibilities.
1 15 4. The chief operating officer of a corporation.
1 16 EXPLANATION
1 17 This bill provides that a business which receives economic
1 18 development assistance from a governmental entity shall enter
1 19 into an agreement with the governmental entity that the
1 20 business will repay the assistance received if the owner of
1 21 the business, a partner or managing partner if the business is
1 22 a partnership or limited partnership, a managing member of a
1 23 limited liability company, or the chief operating officer of a
1 24 corporation is convicted of a violation of a controlled
1 25 substance offense while the agreement is in effect. The
1 26 agreement must be in effect for at least one year.
