1 1 Section 1. Section 455A.4, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. Before the environmental protection
1 4 commission or natural resource commission adopts a rule, the
1 5 director shall give notice to the chairperson, vice
1 6 chairperson, and ranking member of the committees of the
1 7 general assembly which have jurisdiction over environmental
1 8 issues. The notice shall be given at least thirty-five days
1 9 in advance of the submission of the notice of intended action
1 10 under section 17A.4, subsection 1, and shall include either a
1 11 statement summarizing the terms or substance of the intended
1 12 action or a summary description of the subjects and the issues
1 13 involved.
1 14 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 15 immediate importance, takes effect upon enactment.
1 16 EXPLANATION
1 17 This bill requires that before the environmental protection
1 18 commission or natural resource commission adopts a rule, the
1 19 director of the department of natural resources shall give
1 20 notice to the chairperson, vice chairperson, and ranking
1 21 member of the committees of the general assembly which have
1 22 jurisdiction over environmental issues. The notice shall be
1 23 given at least 35 days in advance of the submission of the
1 24 notice of intended action under section 17A.4, and shall
1 25 include either a statement summarizing the terms or substance
1 26 of the intended action or a summary description of the
1 27 subjects and the issues involved. The bill takes effect upon
1 28 enactment.
