1 1 Section 1. Section 321.194, subsection 1, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. c. Each person fourteen or fifteen years
1 4 of age issued a class C or M driver's license pursuant to this
1 5 section shall be the only occupant or rider of a motor vehicle
1 6 operated in accordance with paragraph "a", unless the person
1 7 occupying the seat beside the operator possessing a class C
1 8 driver's license is a person holding a valid motor vehicle
1 9 license who is the parent or guardian of the licensee, a
1 10 member of the licensee's immediate family, an approved driver
1 11 education instructor, a prospective driver education
1 12 instructor who is enrolled in a practitioner preparation
1 13 program with a safety education program approved by the state
1 14 board of education, or a person who is twenty-five years of
1 15 age or more if written permission to accompany the licensee as
1 16 provided in this paragraph is granted by the licensee's parent
1 17 or guardian.
1 18 EXPLANATION
1 19 This bill requires a person issued a special minors'
1 20 driver's license under section 321.194 to be the only occupant
1 21 of a motor vehicle or the only rider of a motorcycle operated
1 22 in accordance with paragraph "a", unless the person occupying
1 23 the motor vehicle seat beside the driver is a person issued a
1 24 valid motor vehicle license who is the parent or guardian of
1 25 the licensee, a member of the licensee's immediate family, an
1 26 approved driver education instructor, a prospective driver
1 27 education instructor who is enrolled in a practitioner
1 28 preparation program with a safety education program approved
1 29 by the state board of education, or a person who is at least
1 30 25 years of age if written permission is granted by the
1 31 licensee's parent or guardian. The section of the Code
1 32 amended provides that the department of transportation may
1 33 suspend a special minors' driver's license upon receiving
1 34 satisfactory evidence that the licensee has violated the
1 35 provision amended by this bill. Under section 805.8, the
2 1 scheduled fine for a violation of the provisions is $20.
