PAG LIN 1 1 Section 1. Section 607A.3, Code 1995, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 2A. "Disabled" means a person who has a 1 4 disability covered by the federal Americans with Disabilities 1 5 Act, 42 U.S.C. } 12112(a) et seq. 1 6 Sec. 2. Section 607A.8, Code 1995, is amended to read as 1 7 follows: 1 8 607A.8 FEES AND EXPENSES FOR JURORS. 1 9 Grand jurors and petit jurors in all courts shall receive 1 10 ten dollars as compensation for each day's service or 1 11 attendance, including attendance required for the purpose of 1 12 being considered for service, reimbursement for mileage 1 13 expenses at the rate specified insection 70A.9 orsection 1 14 602.1509 for each mile traveled each day to and from their 1 15 residences to the place of service or attendance, and 1 16 reimbursement for actual expenses of parking, as determined by 1 17 the clerk. A juror who is disabled may receive reimbursement 1 18 for the costs of alternate transportation from the disabled 1 19 juror's residence to the place of service or attendance. A 1 20 juror shall not receive reimbursement for mileage expenses or 1 21 actual expenses of parking when the juror travels in a vehicle 1 22 for which another juror is receiving reimbursement for mileage 1 23 and parking expenses. 1 24 Sec. 3. Section 622.69, unnumbered paragraph 1, Code 1995, 1 25 is amended to read as follows: 1 26 Witnesses shall receive ten dollars for each full day's 1 27 attendance, and five dollars for each attendance less than a 1 28 full day, and mileage expensesat the rate specified in1 29section 70A.9pursuant to section 602.1509 for each mile 1 30 actually traveled. 1 31 EXPLANATION 1 32 Section 1 of the bill defined "disabled" as a person who 1 33 has a disability covered by the federal Americans with 1 34 Disabilities Act, codified at 42 U.S.C. } 12112(a) et seq. 1 35 Section 2 of the bill provides that a juror who is disabled 2 1 may receive reimbursement for the costs of alternate 2 2 transportation from the disabled juror's residence to the 2 3 place of the jury service or attendance. Existing law 2 4 provides only reimbursement for mileage and parking expenses. 2 5 Sections 2 and 3 of the bill provide that jurors or 2 6 witnesses may receive reimbursement for mileage expenses for 2 7 each mile traveled in an amount that does not exceed a maximum 2 8 to be established by the supreme court. Existing law set out 2 9 in sections 2 and 3 directs in the alternative that in a Code 2 10 section relating to public officers and employees, the 2 11 reimbursement of the mileage expenses of jurors or witnesses 2 12 shall be the amount that is the maximum allowable by federal 2 13 internal revenue service regulations. 2 14 LSB 4251HV 76 2 15 kah/cf/24
