1 1 Section 1. Section 384.20, Code 1995, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. Continuing appropriation means
1 4 the unexpended portion of the cost of public improvements, as
1 5 defined in section 384.95, which cost was adopted through a
1 6 public hearing pursuant to section 384.102 and was included in
1 7 an adopted or amended budget of a city. A continuing
1 8 appropriation does not expire at the conclusion of a fiscal
1 9 year. A continuing appropriation continues until the public
1 10 improvement is completed, but expenditures under the
1 11 continuing appropriation shall not exceed the resources
1 12 available for paying for the public improvement.
1 13 EXPLANATION
1 14 This bill defines a city continuing appropriation as the
1 15 unexpended portion of the cost of public improvements, which
1 16 cost was adopted after a public hearing and was included in an
1 17 adopted or amended budget of a city. A continuing
1 18 appropriation continues until the public improvement is
1 19 completed but the expenditures under the continuing
1 20 appropriation shall not exceed the resources available to pay
1 21 for the public improvement. A continuing appropriation does
1 22 not expire at the conclusion of a fiscal year.
