PAG LIN 1 1 Section 1. NEW SECTION. 261.110 DEFINITIONS. 1 2 As used in this division, unless the context otherwise 1 3 requires: 1 4 1. "Accredited higher education institution" means a 1 5 public or private institution of higher learning located in 1 6 Iowa that meets the requirements established in section 1 7 261.92, subsection 1. 1 8 2. "Commission" means the college student aid commission. 1 9 3. "Full-time resident student" means an individual 1 10 resident of Iowa who is enrolled at an accredited higher 1 11 education institution located in Iowa in a course of study 1 12 including at least twelve semester hours or the trimester 1 13 equivalent of twelve semester hours or the quarter equivalent 1 14 of twelve semester hours. "Course of study" does not include 1 15 correspondence courses. 1 16 4. "Grant" means an award by the state of Iowa to an 1 17 accredited higher education institution for a qualified 1 18 resident student under the Iowa military service grant 1 19 program. 1 20 5. "Part-time resident student" means an individual 1 21 resident of Iowa who is enrolled at an accredited higher 1 22 education institution located in Iowa in a course of study 1 23 including at least three semester hours or the trimester or 1 24 the four quarter equivalent of three semester hours. "Course 1 25 of study" does not include correspondence courses. 1 26 6. "Qualified student" means a resident student who has 1 27 received an honorable discharge from a branch of the armed 1 28 services of the United States of America or the state military 1 29 forces, after having served a minimum of four years on active 1 30 duty, and who is making satisfactory progress toward 1 31 graduation. 1 32 Sec. 2. NEW SECTION. 261.111 PROGRAM ESTABLISHED – 1 33 ELIGIBILITY. 1 34 An Iowa military service grant program is established. A 1 35 military service grant may be awarded to a resident of Iowa 2 1 who is admitted and in attendance as a full-time or part-time 2 2 resident student at an accredited higher education institution 2 3 and who has received an honorable discharge from a branch of 2 4 the armed services of the United States of America or the 2 5 state military forces, after having served a minimum of four 2 6 years on active duty. The individual's permanent residence 2 7 during the years of service on active duty shall have been in 2 8 Iowa. Grants awarded shall be distributed to the appropriate 2 9 accredited higher education institution for payment of 2 10 educational expenses, including tuition, room, board, and 2 11 mandatory fees, with any balance to be distributed to the 2 12 student for whom the grant is awarded. 2 13 Sec. 3. NEW SECTION. 261.112 EXTENT OF GRANT. 2 14 A qualified full-time resident student may receive grants 2 15 for not more than eight semesters of undergraduate study or 2 16 the trimester or quarter equivalent. A qualified part-time 2 17 resident student may receive grants for not more than sixteen 2 18 semesters of undergraduate study or the trimester or quarter 2 19 equivalent. 2 20 Sec. 4. NEW SECTION. 261.113 AMOUNT OF GRANT. 2 21 1. The amount of a grant to a qualified full-time student 2 22 for an academic year shall be one thousand dollars. 2 23 2. The amount of a grant to a qualified part-time student 2 24 enrolled in a course of study shall be equal to the average 2 25 amount of a grant to a full-time student times a number which 2 26 represents twenty-four semester hours, or the trimester or 2 27 quarter equivalent, divided by the number of hours in which 2 28 the part-time student is actually enrolled. 2 29 3. A grant may be made annually for both the fall and 2 30 spring semesters or the trimester equivalent. Payments under 2 31 the grant shall be allocated equally among the semesters or 2 32 trimesters and shall be paid at the beginning of each semester 2 33 or trimester, upon certification by the accredited higher 2 34 education institution that the student is admitted and in 2 35 attendance. If the student discontinues attendance before the 3 1 end of the semester or trimester after receiving payment under 3 2 the grant, the entire amount of any refund due that student, 3 3 up to the amount of any payments made under the annual grant, 3 4 shall be paid by the accredited higher education institution 3 5 to the state. 3 6 Sec. 5. NEW SECTION. 261.114 ADMINISTRATION BY 3 7 COMMISSION – RULES. 3 8 The commission shall administer this program and shall: 3 9 1. Provide application forms to qualified students 3 10 enrolled and attending or seeking to enroll and attend an 3 11 accredited higher education institution. 3 12 2. Adopt rules for defining tuition and mandatory fees, 3 13 defining residence for the purposes of the Iowa military 3 14 service grant program, and processing and approving 3 15 applications for grants. In determining who is a resident of 3 16 Iowa, the commission's rules shall be at least as restrictive 3 17 as those of the board of regents. 3 18 3. Approve and award grants to accredited higher education 3 19 institutions under the program. 3 20 4. Report annually to the governor and general assembly 3 21 and include in the report an evaluation of the Iowa military 3 22 service grant program for the period. The commission may 3 23 require the accredited higher education institution to 3 24 promptly furnish any information that the commission may 3 25 request in connection with the Iowa military service grant 3 26 program. 3 27 5. Provide for the proration of funds among qualified 3 28 applicants if funds available are insufficient to pay all 3 29 approved grants. 3 30 Sec. 6. NEW SECTION. 261.115 APPLICATION FOR GRANTS. 3 31 Each applicant, in accordance with the rules of the 3 32 commission, shall: 3 33 1. Complete and file an application for a grant on forms 3 34 provided by the commission. 3 35 2. Submit promptly information requested by the 4 1 commission. 4 2 3. File a new application annually, by which the 4 3 applicant's eligibility for a renewed grant will be evaluated 4 4 and determined. 4 5 Sec. 7. NEW SECTION. 261.116 APPROPRIATION. 4 6 There is appropriated from the general fund of the state to 4 7 the college student aid commission funds sufficient to pay the 4 8 Iowa military service tuition grants approved pursuant to this 4 9 division. 4 10 EXPLANATION 4 11 This bill creates the Iowa military service grant program 4 12 to be administered by the Iowa college student aid commission. 4 13 The bill appropriates from the general fund an amount 4 14 sufficient to fund the program, which is established to 4 15 provide grants to Iowa residents who have received honorable 4 16 discharges from the United States armed forces after at least 4 17 four years of active duty service, whose permanent residence 4 18 during active duty service was in Iowa, and who are enrolled 4 19 at an accredited higher education institution located in Iowa 4 20 as full-time or part-time resident students. 4 21 Grants awarded shall be distributed to the appropriate 4 22 accredited higher education institution for payment of 4 23 educational expenses, including tuition, room, board, and 4 24 mandatory fees, with any balance to be distributed to the 4 25 student. 4 26 Qualified full-time students may receive grants of $1,000 4 27 annually for not more than eight semesters of undergraduate 4 28 study or the trimester or quarter equivalent. A qualified 4 29 part-time resident student may receive prorated grants for not 4 30 more than 16 semesters of undergraduate study or the trimester 4 31 or quarter equivalent. 4 32 The commission is charged with providing application forms 4 33 to students enrolled and attending or seeking to enroll and 4 34 attend an accredited higher education institution; adopting 4 35 rules for defining tuition and mandatory fees, defining 5 1 residence for the purposes of the Iowa military service grant 5 2 program, and processing and approving applications for grants; 5 3 approving and awarding grants to accredited higher education 5 4 institutions under the program; and reporting the results of 5 5 an annual evaluation of the program to the governor and 5 6 general assembly. If funds are insufficient to pay all 5 7 approved grants, the commission is also charged with prorating 5 8 the funds among qualified applicants. 5 9 Each applicant is required to complete and file an 5 10 application for a grant on forms provided by the commission, 5 11 submit promptly information requested by the commission, and 5 12 file a new application annually. 5 13 LSB 3506YH 76 5 14 kh/sc/14
