1 1 Section 1. NEW SECTION. 85.1B PILOT PROJECT –
1 2 OCCUPATIONAL AND NONOCCUPATIONAL HEALTH CARE COVERAGE FOR
1 3 EMPLOYEES.
1 4 The division of industrial services of the department of
1 5 employment services may establish through the adoption of
1 6 rules pursuant to chapter 17A a pilot project, the purpose of
1 7 which is to authorize participating employers to contract with
1 8 a licensed health care service plan to be the exclusive
1 9 provider of medical, surgical, and hospital treatment for
1 10 occupational and nonoccupational injuries and illnesses
1 11 incurred by employees. The health care service plan shall
1 12 provide all occupational-related medical treatment coverage
1 13 required without any payment by the employees of deductibles,
1 14 copayments, or any share of the premium. Employers
1 15 participating in the pilot project shall make available health
1 16 care coverage for their employees' dependents for the
1 17 treatment of nonoccupational injuries and illnesses. This
1 18 section does not require employers to pay for dependent
1 19 coverage. Employers participating in the pilot project shall
1 20 offer employees a choice between an exclusive provider of care
1 21 option and a traditional health benefits plan which allows
1 22 employees to obtain workers' compensation treatment from a
1 23 traditional workers' compensation provider. In the case of a
1 24 pilot project established by a multiemployer, collectively
1 25 bargained employee welfare benefit plan, or by a recognized
1 26 exclusive bargaining agent for state employees that sponsors
1 27 an employee welfare benefit plan for the benefit of employees,
1 28 this choice may be exercised by an exclusive or certified
1 29 bargaining agent that represents employees of the employer.
1 30 EXPLANATION
1 31 This bill allows the division of industrial services of the
1 32 department of employment services to adopt rules establishing
1 33 a pilot project to authorize employers to contract to provide
1 34 health care to its employees for both occupational and
1 35 nonoccupational injuries and illnesses.
