PAG LIN 1 1 Section 1. Section 321L.2, subsection 1, paragraph a, Code 1 2 Supplement 1995, is amended by adding the following new 1 3 unnumbered paragraph: 1 4 NEW UNNUMBERED PARAGRAPH. A handicapped person who is a 1 5 nonresident of this state, but who is temporarily residing 1 6 with a resident of this state, may apply for a temporary 1 7 handicapped identification device which shall be issued to the 1 8 nonresident applicant if the nonresident complies with the 1 9 requirements of this paragraph. The device shall be valid for 1 10 no longer than thirty days from the date of issuance. Upon 1 11 application, the nonresident handicapped person and the 1 12 resident with whom the applicant temporarily resides shall 1 13 provide the department with such information as the department 1 14 requires for application for handicapped residents under this 1 15 section. However, the department shall accept a statement 1 16 from a physician or chiropractor who is not licensed within 1 17 this state or a contiguous state, if the statement is written 1 18 on the physician's or chiropractor's stationary and if it 1 19 describes the nature of the applicant's handicap. 1 20 EXPLANATION 1 21 This bill requires the state department of transportation 1 22 to issue a temporary handicapped identification device to a 1 23 person who is a nonresident of this state if the person is 1 24 temporarily residing with a resident of this state. The 1 25 temporary handicapped identification device is valid for a 1 26 period of 30 days from the date of issuance. The nonresident 1 27 applicant and the resident with whom the applicant temporarily 1 28 resides must provide the department with the same information 1 29 as the department requires for application for handicapped 1 30 residents. However, the department is required to accept a 1 31 statement from a physician or chiropractor who is not licensed 1 32 within this state or a contiguous state, if the statement is 1 33 written on the physician's or chiropractor's stationary and if 1 34 it describes the nature of the applicant's handicap. 1 35 LSB 4020HH 76 2 1 js/cf/24
