1 1 Section 1. Section 321.343, unnumbered paragraph 1, Code
1 2 1995, is amended to read as follows:
1 3 The driver of a motor vehicle carrying passengers for hire,
1 4 a school bus, or a vehicle carrying hazardous material and
1 5 required to stop before crossing a railroad track by motor
1 6 carrier safety rules adopted under section 321.449, before
1 7 crossing at grade any track of a railroad, shall stop the
1 8 vehicle within fifty feet but not less than fifteen feet from
1 9 the nearest rail. While stopped, the driver shall listen and
1 10 look in both directions for an approaching train, and for
1 11 signals indicating the approach of a train, and shall not
1 12 proceed until the driver can do so safely. A multipurpose
1 13 passenger vehicle used as a school bus shall not be required
1 14 to stop before crossing a railroad track under this section.
1 15 A multipurpose passenger vehicle includes any multipurpose
1 16 vehicle or automobile used to transport students to and from
1 17 school or extracurricular activities.
1 18 EXPLANATION
1 19 This bill exempts a multipurpose passenger vehicle used as
1 20 a school bus from the requirement that all school buses stop
1 21 before crossing a railroad track. A multipurpose passenger
1 22 vehicle is defined as any multipurpose vehicle or automobile
1 23 used to transport students to and from school or
1 24 extracurricular activities. A multipurpose vehicle is defined
1 25 in section 321.1 to mean a motor vehicle designed to carry not
1 26 more than 10 people, and constructed either on a truck chassis
1 27 or with special features for occasional off-road operation.
1 28 An automobile is defined in section 321.1 to mean a motor
1 29 vehicle designed primarily for carrying nine passengers or
1 30 less.
