PAG LIN 1 1 Section 1. Section 350.4, Code 1995, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 11. a. To issue, upon payment of a fee, 1 4 a park user permit for motor vehicles which are required to 1 5 display a park user permit within the boundaries of public 1 6 parks, forests, recreational areas, preserves, or parkways 1 7 under the jurisdiction of the county conservation board. If a 1 8 park user permit system is established by the county 1 9 conservation board, the county conservation board shall also 1 10 set the park user permit fee for the county, provide for the 1 11 sale and distribution of the permits, specify where the permit 1 12 is to be attached or displayed on vehicles, and designate the 1 13 public lands and facilities under its jurisdiction where a 1 14 valid park user permit is required. The proceeds from permit 1 15 fees collected by the county conservation board shall be 1 16 credited to the county general fund and used for county 1 17 conservation board purposes. A person who, without a permit, 1 18 parks or permits to be parked a motor vehicle within a public 1 19 park, forest, recreational area, preserve, or parkway under 1 20 the jurisdiction of the county conservation board where a park 1 21 user permit is required to be attached to or displayed on the 1 22 motor vehicle is guilty of a simple misdemeanor which is 1 23 punishable by a scheduled fine as specified in section 805.8, 1 24 subsection 6, paragraph "a". 1 25 b. This subsection does not apply to the following motor 1 26 vehicles: 1 27 (1) A motor vehicle which is registered pursuant to 1 28 chapter 321. 1 29 (2) An official government vehicle operated by a state, 1 30 county, city, school district, or federal employee or agent 1 31 while in the performance of official government business. 1 32 (3) A motor vehicle moving on a public road within or that 1 33 crosses county land to which this subsection applies. 1 34 Sec. 2. NEW SECTION. 461A.81 PARK USER PERMIT – OUT-OF- 1 35 STATE MOTOR VEHICLES. 2 1 1. A person shall not park or permit to be parked a motor 2 2 vehicle on land under the jurisdiction of the department where 2 3 a park user permit is required pursuant to this section, 2 4 unless the motor vehicle has a park user permit attached to or 2 5 displayed on the motor vehicle as provided in this section. 2 6 2. The commission may establish, by rule adopted pursuant 2 7 to chapter 17A, a park user permit system which shall apply to 2 8 land under the jurisdiction of the department as designated by 2 9 the commission. The rules shall set the permit fee, specify 2 10 the procedures for sale and distribution of the permits, 2 11 provide for the display of a permit, and determine other 2 12 matters deemed necessary for the effective administration of 2 13 the permit system. The receipts from the permit fees shall be 2 14 credited to the state conservation fund. 2 15 3. This section does not apply to the following motor 2 16 vehicles: 2 17 a. A motor vehicle which is registered pursuant to chapter 2 18 321. 2 19 b. An official government vehicle operated by a state, 2 20 county, city, school district, or federal employee or agent 2 21 while in performance of official business. 2 22 c. A motor vehicle moving on a public road within or that 2 23 crosses state land to which this section applies. 2 24 4. A person who parks or permits to be parked a motor 2 25 vehicle on land under the jurisdiction of the department in 2 26 violation of the requirements of this section is guilty of a 2 27 simple misdemeanor which is punishable by a scheduled fine 2 28 specified in section 805.8, subsection 6, paragraph "a". 2 29 Sec. 3. Section 805.8, subsection 6, paragraph a, Code 2 30 Supplement 1995, is amended to read as follows: 2 31 a. For violations under section 350.4, subsection 11, and 2 32 sections 461A.39, 461A.45,and461A.50, and 461A.81, the 2 33 scheduled fine is ten dollars. 2 34 Sec. 4. EFFECTIVE DATE. This Act takes effect January 1, 2 35 1997. 3 1 EXPLANATION 3 2 This bill authorizes the county conservation boards and the 3 3 natural resource commission to establish a park user permit 3 4 system for forests, parks, and recreation areas which the 3 5 boards and the commission designate. The park permit user 3 6 system will apply to out-of-state registered motor vehicles 3 7 only. The park user permits do not apply to motor vehicles 3 8 registered in Iowa pursuant to chapter 321. 3 9 If the commission and the county conservation board, 3 10 individually, decide to impose a user permit system on the 3 11 land under their jurisdiction, each will determine which 3 12 properties will be affected by the permits, the amount of the 3 13 fee, and other necessary administrative details. Receipts 3 14 from state permits will be credited to the state conservation 3 15 fund and the county receipts will be credited to the county 3 16 general fund and used for county conservation purposes. 3 17 The penalty for violations is a scheduled fine of $10. 3 18 This bill takes effect January 1, 1997. 3 19 LSB 3065HH 76 3 20 tj/jw/5.2
