1 1 Section 1. Section 455B.151, subsection 2, paragraph c,
1 2 Code 1995, is amended to read as follows:
1 3 c. "Waste" means toxic or hazardous waste as identified
1 4 and included in the consolidated chemical list pursuant to
1 5 Title III of the federal Superfund Amendments and
1 6 Reauthorization Act of 1986, or substances which have been
1 7 treated with a toxic or hazardous waste or infectious waste,
1 8 as defined in section 455B.501. "Waste" does not include
1 9 waste oil which is burned under federal environmental
1 10 protection agency guidelines for purposes of volume reduction,
1 11 heat production, or energy cogeneration.
1 12 EXPLANATION
1 13 Current law places a moratorium on the construction and
1 14 operation of commercial waste incinerators within the state of
1 15 Iowa until such time as the department of natural resources or
1 16 the United States environmental protection agency adopts rules
1 17 which establish safe emission standards for releases of toxic
1 18 air emissions from commercial waste incinerators. This bill
1 19 expands the definition of and the ban on commercial waste
1 20 incinerators by including commercial infectious waste
1 21 incinerators within the definition of a commercial waste
1 22 incinerator. The bill does this by expanding the definition
1 23 of waste which shall not be incinerated to include infectious
1 24 waste.
