1 1 Section 1. NEW SECTION. 239.10 IMMUNIZATION REQUIREMENT.
1 2 The department shall adopt rules requiring immunization of
1 3 children receiving assistance under this chapter. The rules
1 4 shall conform to the administrative rules for immunization of
1 5 children adopted by the Iowa department of public health under
1 6 section 139.9, including but not limited to the exemptions
1 7 from the immunization requirement in section 139.9, subsection
1 8 4. The rules shall specify the types of immunizations
1 9 required, age groupings, and other provisions, and shall
1 10 provide additional exemptions to the requirement for good
1 11 cause or for factors beyond the control of the child's parent,
1 12 guardian, or custodian. Unless exempt by rule, the department
1 13 shall reduce the family size used to determine the assistance
1 14 grant under this chapter for each child not in compliance with
1 15 the immunization requirement, until the recipient family
1 16 complies with the immunization requirement.
1 17 EXPLANATION
1 18 This bill directs the department of human services to adopt
1 19 rules requiring the immunization of children under the family
1 20 investment program. The rules are to conform with rules for
1 21 immunization of children adopted by the Iowa department of
1 22 public health under section 139.9. Section 139.9 allows
1 23 exemptions from immunization requirements for schools and
1 24 child day care facilities for health and religious reasons.
1 25 The rules are to specify the types of immunizations required
1 26 and provide additional exemptions from the requirement for
1 27 good cause or for circumstances beyond the control of the
1 28 child's parent, guardian, or custodian. The department shall
1 29 reduce the family size used to compute the amount of the
1 30 family investment program grant to reflect each child not in
1 31 compliance with the immunization requirement until the family
1 32 complies, unless exempt by rule.
