PAG LIN 1 1 Section 1. NEW SECTION. 282.9 ENROLLMENT OPTIONS IN 1 2 ADJOINING STATES. 1 3 1. Iowa students and students residing in adjoining states 1 4 that have reciprocal agreements may enroll in school districts 1 5 in the other state. In order to qualify for this option the 1 6 students must be residents of a county which is contiguous to 1 7 a state border. 1 8 The intention of an out-of-state student to enroll in an 1 9 Iowa school district shall be made known to the affected 1 10 school district before July 1 of the school year of 1 11 enrollment. 1 12 2. A non-Iowa student who resides in a school district in 1 13 a county that borders Iowa may enroll in an Iowa school 1 14 district if either the school board of the district in which 1 15 the student resides or the state in which the student resides 1 16 pays tuition to the Iowa school district in which the student 1 17 is enrolled, provided adequate classroom space is available in 1 18 the Iowa school district as determined by the board of the 1 19 school district. The tuition must be comparable to the 1 20 tuition established according to section 282.24. 1 21 In each odd-numbered year, before March 1, the state board 1 22 of education shall agree to rates of tuition for Iowa 1 23 elementary and secondary students attending in other states 1 24 for the next two fiscal years. The board shall negotiate 1 25 equal, reciprocal rates with the designated authority in each 1 26 state applicable to students who reside in another adjoining 1 27 state and enroll in an Iowa school district. 1 28 3. It is the primary responsibility of a parent or 1 29 guardian to provide transportation for students attending 1 30 school pursuant to this section. However, for any student 1 31 attending school pursuant to this section, the provision of 1 32 student transportation may be negotiated between the districts 1 33 of residence and attendance with consideration given to 1 34 differing transportation needs. Transportation options may 1 35 include bus service to and from the district boundary or to 2 1 and from a student's home. 2 2 EXPLANATION 2 3 This bill provides that students in adjoining states with 2 4 reciprocal agreements allowing Iowa students to enroll in that 2 5 state's schools may enroll in Iowa's schools if notice is 2 6 received by July 1 and there is adequate classroom space. 2 7 Transportation and tuition are to be negotiated, with 2 8 transportation negotiated by the districts, and tuition 2 9 negotiated by the state authorities designated in each state. 2 10 LSB 3666HH 76 2 11 kh/jj/8
