PAG LIN 1 1 Section 1. DEFINITIONS. As used in this Act, unless the 1 2 context otherwise requires: 1 3 1. "Committee" means the state gambling impact and policy 1 4 committee. 1 5 2. "Director" means the director of the state gambling and 1 6 policy committee. 1 7 Sec. 2. SHORT TITLE. This Act may be cited as the "State 1 8 Gambling Impact and Policy Committee Act". 1 9 Sec. 3. COMMITTEE CREATED &endash; MEMBERSHIP &endash; VACANCY. 1 10 1. A state gambling impact and policy committee is 1 11 created. The membership of the committee shall include the 1 12 lieutenant governor who shall serve as chairperson of the 1 13 committee and eight additional members appointed as provided 1 14 in subsection 2. 1 15 2. The eight additional members shall be appointed as 1 16 follows: 1 17 a. Two members shall be appointed by the governor. 1 18 b. Two members shall be appointed by the majority leader 1 19 of the senate and one member by the minority leader of the 1 20 senate. 1 21 c. Two members shall be appointed by the speaker of the 1 22 house of representatives and one member by the minority leader 1 23 of the house of representatives. 1 24 3. The members shall be appointed for the life of the 1 25 committee. A vacancy in the committee shall be filled in the 1 26 same manner as the original appointment. 1 27 Sec. 4. COMMITTEE PROCEDURES. 1 28 1. The chairperson of the committee shall call its first 1 29 meeting within thirty days after the date on which all members 1 30 of the committee are appointed. Thereafter, the committee 1 31 shall meet at the call of the chairperson. 1 32 2. A majority of the members of the committee shall 1 33 constitute a quorum, but a lesser number of members may hold 1 34 public hearings. 1 35 3. The committee may elect a vice chairperson and other 2 1 officers of the committee as appropriate. 2 2 4. The members of the committee are entitled to 2 3 reimbursement for travel and other necessary expenses incurred 2 4 in the performance of official duties. Each member may also 2 5 be eligible to receive compensation as provided in section 2 6 7E.6. The compensation and expenses shall be paid from funds 2 7 appropriated for that purpose. 2 8 Sec. 5. DUTIES OF THE COMMITTEE &endash; STUDY COMPLETION. 2 9 1. The committee shall conduct a comprehensive legal and 2 10 factual study of gambling in this state and existing policies 2 11 and practices with respect to the legalization or prohibition 2 12 of gambling activities and formulate and propose changes in 2 13 those policies and practices as the committee deems 2 14 appropriate. The committee may seek the cooperation of other 2 15 states and tribal councils in obtaining information regarding 2 16 gambling activities within those jurisdictions. 2 17 2. The study shall include, but is not limited to, the 2 18 following matters: 2 19 a. The economic impact of gambling on the state of Iowa, 2 20 political subdivisions of this state, and native American 2 21 tribes conducting gambling activities in this state. 2 22 b. The economic impact of gambling on other businesses. 2 23 c. An assessment and review of the political contributions 2 24 and influences of gambling businesses and promoters on the 2 25 development of public policy regulating gambling. 2 26 d. An assessment of the relationship between gambling and 2 27 crime. 2 28 e. An assessment of the impact of pathological or problem 2 29 gambling on individuals, families, social institutions, 2 30 criminal activity, and the economy. 2 31 f. A review of the demographics of gamblers. 2 32 g. A review of the effectiveness of existing practices in 2 33 law enforcement, judicial administration, and corrections to 2 34 combat and deter illegal gambling and illegal activities 2 35 related to gambling. 3 1 h. A review of the costs and effectiveness of state and 3 2 federal gambling regulatory policy. 3 3 i. Other relevant issues and topics as considered 3 4 appropriate by the committee. 3 5 3. The committee shall complete its study and submit its 3 6 final report to the governor and the general assembly not 3 7 later than January 31, 1998. The final report shall contain a 3 8 detailed statement of the findings and conclusions of the 3 9 committee with its recommendations for legislation and 3 10 administrative actions as the committee deems appropriate. 3 11 Sec. 6. POWERS OF THE COMMITTEE. 3 12 1. The committee may hold hearings, administer oaths, take 3 13 testimony, receive evidence, and require by subpoena the 3 14 attendance and testimony of witnesses and the production of 3 15 materials as the committee considers advisable to carry out 3 16 the purposes of this Act. 3 17 A subpoena of the committee shall be served in the manner 3 18 provided for a subpoena issued by a district court under the 3 19 Iowa rules of civil procedure. A subpoena may be served 3 20 anywhere in the judicial district in which the person required 3 21 to be served resides or may be found. A subpoena shall state 3 22 the time and place a person is required to appear, be signed 3 23 by the chairperson or vice chairperson of the committee, and 3 24 be attested to by the executive director of the committee. 3 25 2. Upon request of the chairperson of the committee, the 3 26 head of any state agency shall furnish the committee with the 3 27 information considered necessary by the committee to carry out 3 28 the provisions of this Act. 3 29 3. The chairperson of the committee may appoint and 3 30 terminate the employment of an executive director and any 3 31 additional personnel as may be necessary to enable the 3 32 committee to perform its duties. The appointment or 3 33 termination of the employment of an executive director is 3 34 subject to confirmation by the members of the committee. 3 35 Sec. 7. TERMINATION OF THE COMMITTEE. The committee shall 4 1 terminate thirty days after the date on which the committee 4 2 submits its final report. 4 3 Sec. 8. APPROPRIATION. There is appropriated from the 4 4 general fund of the state to the state gambling impact and 4 5 policy committee, the sum of two hundred thousand dollars, or 4 6 so much thereof as is necessary, to carry out the study as 4 7 provided in this Act. Notwithstanding section 8.33, any 4 8 unobligated or unencumbered money remaining from this 4 9 appropriation shall not revert to the general fund of the 4 10 state before February 1, 1998. 4 11 Sec. 9. EFFECTIVE DATE. This Act, being deemed of 4 12 immediate importance, takes effect upon enactment. 4 13 EXPLANATION 4 14 This bill creates a state gambling impact and policy 4 15 committee consisting of nine members to conduct a 4 16 comprehensive legal and factual study of gambling in this 4 17 state and existing policies and practices with respect to the 4 18 legalization or prohibition of gambling activities, and 4 19 formulate and propose changes in those policies as the 4 20 committee deems appropriate. 4 21 The lieutenant governor shall serve as the chairperson of 4 22 the committee. The remaining eight members are appointed as 4 23 follows: two shall be appointed by the governor; two members 4 24 each shall be appointed by the majority leaders of the house 4 25 and senate; and one member each shall be appointed by the 4 26 minority leaders of the house and senate. 4 27 The bill specifies the various study components including, 4 28 but not limited to, the following: 4 29 1. Economic impact on state and local government and 4 30 native American tribal councils. 4 31 2. Economic impact on other businesses. 4 32 3. Assessment of the influence of gambling interests on 4 33 public policy relating to the regulation of gambling. 4 34 4. Assessment of the relationship between gambling and 4 35 crime. 5 1 5. Assessment of the impact of pathological or problem 5 2 gambling on individuals, families, social institutions, and 5 3 others. 5 4 6. Review of the effectiveness of existing practices in 5 5 law enforcement, judicial administration, and corrections. 5 6 The committee is empowered to hold hearings, administer 5 7 oaths, take testimony, and if necessary, require attendance 5 8 and testimony by subpoena. The chairperson may employ an 5 9 executive director and other staff as necessary. The 5 10 employment of an executive director is subject to confirmation 5 11 by the other committee members. 5 12 The study report is to be completed and submitted to the 5 13 governor and the general assembly not later than January 31, 5 14 1998. The committee will terminate 30 days after the final 5 15 report is submitted. 5 16 This bill appropriates $200,000 from the general fund of 5 17 the state for the study. 5 18 This bill takes effect upon enactment. 5 19 LSB 3123YH 76 5 20 tj/cf/24
