  1  1    Section 1.  Section 312.8, Code 1995, is amended to read as
  1  2 follows:
  1  3    312.8  AMANA COLONIES.
  1  4    Where a tract of land is owned by a corporation organized
  1  5 under the provisions of chapter 490 with assets of the value
  1  6 of one million dollars or more, and having one or more platted
  1  7 villages located within the territorial limits of said the
  1  8 tract of land, all of the territory within the plats of said
  1  9 the villages with their addition or subdivisions shall, for
  1 10 the purposes of this chapter, be deemed to be one incorporated
  1 11 city.  An Amana road fund board is created.  Board members
  1 12 shall be elected in the same manner as trustees of a land use
  1 13 district board are elected and the board shall govern itself
  1 14 in the same manner as a land use district board of trustees
  1 15 pursuant to sections 303.49 and 303.52.  All funds to become
  1 16 due to said the villages so consolidated shall be paid to the
  1 17 county auditor of the county in which said tract of land and
  1 18 said villages are situated.  Said fund shall, thereupon, be
  1 19 administered and expended by the county board of supervisors
  1 20 of said county deposited in the Amana road fund which shall be
  1 21 administered by the Amana road fund board and used for the
  1 22 construction, reconstruction, repair, and maintenance of roads
  1 23 and streets within the plats of such the villages in the same
  1 24 manner and with the same powers and duties as city councils in
  1 25 cities.  The county board of supervisors, county auditor, and
  1 26 county engineer shall cooperate with the Amana road fund board
  1 27 to provide equipment and services which may be necessary for
  1 28 the administration of the Amana road fund.  In the event If
  1 29 the population of such the villages shall has not have been
  1 30 separately enumerated in the federal census, then said the
  1 31 county board of supervisors shall cause a census of said the
  1 32 villages to be taken as soon as may be after this chapter
  1 33 becomes effective possible, which census shall be used in lieu
  1 34 of the federal census provided for in section 312.3,
  1 35 subsection 2.
  2  1    Sec. 2.  Section 331.362, subsection 4, Code 1995, is
  2  2 amended to read as follows:
  2  3    4.  If a county has land subject to section 312.8, the
  2  4 Amana road fund board shall administer road funds available
  2  5 under that section as prescribed in that section.
  2  6    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2  7 immediate importance, takes effect upon enactment.  
  2  8                           EXPLANATION
  2  9    This bill creates the Amana road fund board to administer
  2 10 the Amana road fund from which moneys are to be used for the
  2 11 construction, reconstruction, repair, and maintenance of roads
  2 12 and streets within the Amana colonies.  The board is elected
  2 13 by the same process and governs itself in the same manner as
  2 14 land use district board of trustees in chapter 303.  The
  2 15 county board of supervisors, county auditor, and county
  2 16 engineer are required to cooperate with the Amana road fund
  2 17 board to provide equipment and services which may be necessary
  2 18 for the administration of the Amana road fund.
  2 19    This bill is effective upon enactment.
