1 1 Section 1. NEW SECTION. 252B.8A INFORMATION PROVIDED TO
1 2 A CONSUMER REPORTING AGENCY &endash; APPROPRIATE USE OF PROCEDURE.
1 3 Notwithstanding the amount of overdue support owed, the
1 4 department shall determine whether application of the
1 5 procedure for providing information to a consumer reporting
1 6 agency is inappropriate in a particular case. The department
1 7 shall refuse to provide information to a consumer reporting
1 8 agency if the obligor demonstrates a consistent and good faith
1 9 effort in payment of support, hardship, or a valid reason for
1 10 noncompliance with a support order. For the purposes of this
1 11 section, "consumer reporting agency" means any person or
1 12 organization which, for monetary fees, dues or on a
1 13 cooperative nonprofit basis, regularly engages in whole or in
1 14 part in the practice of assembling or evaluating consumer
1 15 credit information or other information on consumers for the
1 16 purpose of furnishing consumer reports to third parties, and
1 17 which uses any means or facility of interstate commerce for
1 18 the purpose of preparing or furnishing consumer reports.
1 19 EXPLANATION
1 20 This bill directs the department of human services to
1 21 determine the inappropriate application of the procedure which
1 22 allows the department to report the amount of an obligor's
1 23 overdue child support obligation to a consumer reporting
1 24 agency notwithstanding the amount of overdue support owed.
1 25 The bill specifies that the exception to application of the
1 26 procedure includes demonstration by the obligor of a good
1 27 faith effort to pay support, hardship, or a valid reason for
1 28 noncompliance. The bill also defines "consumer reporting
1 29 agency" for the purposes of the bill.
