  1  1    Section 1.  Section 625.5, Code 1995, is amended to read as
  1  2 follows:
  1  3    625.5  LIABILITY OF SUCCESSFUL PARTY.
  1  4    All costs accrued at the instance of the successful party,
  1  5 which cannot be collected of from the other party, may be
  1  6 recovered on motion by the person entitled to them against the
  1  7 successful party.  However, in situations where the other
  1  8 party was confined in a penitentiary or reformatory when the
  1  9 costs were incurred, costs shall not be recovered from the
  1 10 successful party.  
  1 11                           EXPLANATION
  1 12    This bill provides that costs cannot be collected from a
  1 13 successful party if the losing party is confined in a
  1 14 penitentiary or reformatory when the costs were incurred.
