1 1 Section 1. Section 455B.103A, subsection 1, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. h. Before final approval is given under
1 4 this section for a general permit to discharge stormwater, the
1 5 department shall obtain the services of a local representative
1 6 of the United States natural resource conservation service to
1 7 evaluate the impact of soil erosion and sediment accumulation
1 8 at the point of the stormwater discharge. The impact study
1 9 shall be completed at least thirty days before final approval
1 10 of the general permit. The findings of the evaluation shall
1 11 be made available to the owners of the land adjacent to the
1 12 point of stormwater discharge. If the impact study is not
1 13 completed and available to the public as provided in this
1 14 paragraph, a general permit shall not be issued.
1 15 EXPLANATION
1 16 This bill provides that, before the department of natural
1 17 resources issues a general permit for a stormwater discharge,
1 18 the department shall obtain the services of the United States
1 19 natural resource conservation service to evaluate the impact
1 20 of soil erosion and sediment accumulation at the point of the
1 21 stormwater discharge. The impact study shall be completed at
1 22 least 30 days before the general permit is approved. The
1 23 findings of the investigation are to be made available to the
1 24 owners of land adjacent to the point of the discharge. If the
1 25 impact study is not completed, a general permit shall not be
1 26 issued.
