1 1 Section 1. NEW SECTION. 147.162 PATIENT RECORDS &endash;
1 2 COPIES AVAILABLE &endash; FEE.
1 3 A copy of a record of professional services provided to a
1 4 person which are maintained by a member of a licensed or
1 5 certified profession under Title IV, subtitle 3, shall be
1 6 available to the person named in the record, upon the request
1 7 of the named person. The member of the licensed or certified
1 8 profession may charge the allowable fee, established by the
1 9 department, in exchange for reproduction of the record. The
1 10 department shall establish allowable fees for reproduction of
1 11 records, based upon the actual cost of reproduction of
1 12 records.
1 13 EXPLANATION
1 14 This bill requires a member of a licensed or certified
1 15 profession licensed or certified under Title IV, subtitle 3 of
1 16 the Code, to provide a reproduction of a person's record, for
1 17 whom the member of the licensed or certified profession has
1 18 provided services, to the person named in the record, upon the
1 19 request of the named person. The bill authorizes the member
1 20 of the licensed or certified profession to charge a fee in
1 21 exchange for reproduction of the record. The bill directs the
1 22 Iowa department of public health to establish allowable fees
1 23 based upon the actual cost of reproduction of the records.
