  1  1    Section 1.  NEW SECTION.  514C.11  MINIMUM POSTDELIVERY
  1  2 CARE REQUIREMENTS.
  1  3    1.  Notwithstanding section 514C.6, an individual or group
  1  4 policy of accident or health insurance or individual or group
  1  5 hospital or health care service contract issued pursuant to
  1  6 chapter 509, 514, or 514A or an individual or group health
  1  7 maintenance organization contract issued and regulated under
  1  8 chapter 514B, which is delivered, amended, or renewed on or
  1  9 after July 1, 1996, and which provides maternity benefits,
  1 10 shall provide coverage for a minimum of forty-eight hours of
  1 11 inpatient care following a vaginal delivery and a minimum of
  1 12 ninety-six hours of inpatient care following a cesarean
  1 13 section for the insured mother and newly born child in a
  1 14 hospital licensed pursuant to chapter 135B.
  1 15    2.  a.  A mother and newly born child shall only be
  1 16 discharged prior to the minimum inpatient length of care
  1 17 prescribed under subsection 1 if the attending provider
  1 18 determines that the minimum inpatient stay is not necessary,
  1 19 following consultation with the mother.
  1 20    b.  If the mother and newly born child are discharged
  1 21 pursuant to paragraph "a" prior to the required minimum length
  1 22 of care, the entity providing coverage, as described in
  1 23 subsection 1, shall provide coverage for a postdischarge visit
  1 24 to the mother and newly born child by an attending provider
  1 25 within forty-eight hours of the discharge.  Services provided
  1 26 during the visit shall include but are not limited to a
  1 27 physical assessment of the newly born child, parent education,
  1 28 assistance and training in breast or bottle feeding,
  1 29 assessment of the home support system, and the performance of
  1 30 any medically necessary and appropriate clinical tests.  The
  1 31 services shall be consistent with protocols and guidelines
  1 32 developed by national pediatric, obstetric, and nursing
  1 33 professional organizations for these services.
  1 34    3.  An entity providing coverage, as described in
  1 35 subsection 1, shall not deselect, terminate services to,
  2  1 require additional documentation from, require additional
  2  2 utilization review of, reduce payments, or in any other manner
  2  3 provide disincentives to an attending provider who complies
  2  4 with the provisions of this section.
  2  5    4.  As used in this section, "attending provider" means a
  2  6 pediatrician or other licensed physician attending the newly
  2  7 born child, or an obstetrician, certified nurse-midwife, or
  2  8 other physician attending the mother.  
  2  9                           EXPLANATION
  2 10    This bill requires that an individual or group policy of
  2 11 accident or health insurance, an individual or group hospital
  2 12 or health care service contract, or an individual or group
  2 13 health maintenance organization contract, which is delivered,
  2 14 amended, or renewed on or after July 1, 1996, and which
  2 15 provides maternity benefits, is to provide a minimum of 48
  2 16 hours of inpatient care following a vaginal delivery and a
  2 17 minimum of 96 hours of inpatient care following a cesarean
  2 18 section for an insured mother and the newly born child in a
  2 19 licensed hospital.  The bill also provides that if the
  2 20 attending provider, in consultation with the mother, decides
  2 21 to shorten the required length of stay, a follow-up visit must
  2 22 be provided within 48 hours of the discharge.  The bill
  2 23 designates the follow-up services to be provided by an
  2 24 attending provider and also defines "attending provider".  The
  2 25 bill also prohibits an insurer or other coverage provider from
  2 26 terminating the services of, requiring additional
  2 27 documentation or utilization review, reducing payments, or
  2 28 otherwise providing disincentives to attending providers for
  2 29 compliance with the bill.
