1 1 Section 1. NEW SECTION. 29A.85 TUITION AID PROGRAM.
1 2 1. A member of the national guard who meets the
1 3 eligibility requirements of this subsection is entitled to
1 4 attend and pursue any undergraduate course of study at a
1 5 community college as defined in chapter 260C, or an
1 6 institution of higher learning under the control of the state
1 7 board of regents upon the payment by the member personally of
1 8 fifty percent of the tuition charged by the community college
1 9 or institution of higher learning. The remaining tuition
1 10 shall be paid by the college student aid commission from funds
1 11 appropriated to the commission in subsection 4. To be
1 12 eligible for tuition aid under this section, a national guard
1 13 member shall meet the following conditions:
1 14 a. Be a resident of the state and a member of an Iowa army
1 15 or air national guard unit throughout each semester or
1 16 duration of the vocational program for which the member has
1 17 applied for benefits.
1 18 b. Have satisfactorily completed required initial active
1 19 duty training.
1 20 c. Have satisfactorily performed duty upon return from
1 21 initial active duty training, including a minimum ninety
1 22 percent attendance on scheduled drill dates and at annual
1 23 training with the parent unit.
1 24 d. Have satisfactorily met the entrance requirements for
1 25 admission to a community college, or institution of higher
1 26 learning under the control of the state board of regents, and
1 27 maintain satisfactory academic progress.
1 28 e. Have provided proper notice of national guard status to
1 29 the community college or institution at the time of
1 30 registration for the term in which tuition benefits are
1 31 sought.
1 32 f. Apply to the adjutant general of Iowa, who shall
1 33 determine eligibility and whose decision is final.
1 34 2. Participation in the tuition aid program by an
1 35 accredited private institution, as defined in section 261.9,
2 1 is voluntary. A member of the Iowa national guard who meets
2 2 the eligibility requirements of subsection 1 is entitled to
2 3 attend and pursue any undergraduate course of study at any
2 4 participating accredited private institution, as defined in
2 5 section 261.9, upon payment of tuition less an amount equal to
2 6 fifty percent of the resident tuition rate established for
2 7 institutions of higher learning under the control of the state
2 8 board of regents. The remaining tuition, not to exceed fifty
2 9 percent of the resident tuition rate for a regents university,
2 10 shall be paid by the college student aid commission from funds
2 11 appropriated to the commission in subsection 4.
2 12 3. An eligible member of the national guard, attending an
2 13 educational institution as a full-time student, shall not
2 14 receive tuition aid under this section for more than eight
2 15 semesters, or if attending as a part-time student, not more
2 16 than sixteen semesters of undergraduate study, or the
2 17 trimester or quarter equivalent. A guard member who has met
2 18 the educational requirements for a baccalaureate degree is
2 19 ineligible for tuition aid under this section.
2 20 4. There is appropriated from the general fund of the
2 21 state to the college student aid commission funds in an amount
2 22 sufficient to pay the approved claims of educational
2 23 institutions for tuition aid to eligible Iowa national guard
2 24 members as provided in this section. The eligibility of
2 25 applicants shall be certified by the adjutant general of Iowa
2 26 to the college student aid commission, and all amounts that
2 27 are or become due to a community college, accredited private
2 28 institution, or institution of higher learning under the
2 29 control of the state board of regents under this section shall
2 30 be paid to the college or institution by the college student
2 31 aid commission upon receipt of certification by the president
2 32 or governing board of the educational institution as to
2 33 accuracy of charges made, and as to the attendance of the
2 34 individual at the educational institution. The college
2 35 student aid commission shall maintain an annual record of the
3 1 number of participants and the tuition dollar value of the
3 2 participation.
3 3 5. The college student aid commission shall adopt rules
3 4 pursuant to chapter 17A to administer this section.
3 5 EXPLANATION
3 6 This bill establishes a tuition aid program for eligible
3 7 members of the Iowa army or air national guard. To be
3 8 eligible a member must successfully apply to the adjutant
3 9 general of Iowa, be a resident of Iowa and a member of a guard
3 10 unit throughout each semester or duration of the vocational
3 11 program, satisfactorily complete active duty training,
3 12 satisfactorily perform duty upon return from initial active
3 13 duty training, satisfactorily meet the entrance requirements
3 14 for admission to an Iowa community college, participating
3 15 accredited private institution, or regents university and
3 16 maintain satisfactory academic progress, and provide notice of
3 17 national guard status to the institution at the time of
3 18 registration for the term in which tuition aid is sought.
3 19 An eligible guard member may receive not more than eight
3 20 semesters of assistance if a full-time student, or 16
3 21 semesters of assistance if a part-time student. Those members
3 22 with baccalaureate degrees are ineligible for assistance.
3 23 The bill appropriates to the college student aid commission
3 24 an amount sufficient to pay for the tuition aid. The guard
3 25 member is responsible for 50 percent of tuition and the
3 26 commission pays for the remainder of the tuition with the
3 27 funds appropriated. However, if the guard member attends an
3 28 accredited private institution which voluntarily participates
3 29 in the tuition aid program, the commission shall pay an amount
3 30 not more than 50 percent of the resident tuition rate
3 31 established for institutions of higher learning governed by
3 32 the state board of regents.
3 33 Amounts due to a community college, accredited private
3 34 institution, or regents university shall be paid to the
3 35 college, institution, or university, by the college student
4 1 aid commission upon receipt of certification by the president
4 2 or governing board of the institution as to accuracy of
4 3 charges made, and as to the attendance of the individual at
4 4 the educational institution. The director is required to
4 5 maintain an annual record of the number of participants and
4 6 the tuition dollar value of the participation. The commission
4 7 is required to adopt rules for the implementation of the
4 8 program.
