  1  1    Section 1.  Section 455D.11, subsection 1, paragraph f,
  1  2 Code 1995, is amended to read as follows:
  1  3    f.  (1)  "Waste tire" means a tire that is no longer
  1  4 suitable for its originally intended purpose due to wear,
  1  5 damage, or defect.
  1  6    (2)  "Waste tire" does not include a any of the following:
  1  7    (a)  A pneumatic tire.
  1  8    (b)  A processed tire which is used in part or in whole for
  1  9 the construction of erosion control structures, French drains,
  1 10 leachate beds, septic system drain fields, road base,
  1 11 culverts, field crossings, intakes, or other uses where the
  1 12 intended purpose is to produce a beneficial product.
  1 13    (3)  For the purposes of this section and sections 455D.11A
  1 14 and 455D.11B, a pneumatic tire and a processed tire are not
  1 15 solid waste as defined in section 455B.301.  
  1 16                           EXPLANATION
  1 17    This bill excludes from the definition of "waste tire"
  1 18 processed tires which are used in part or in whole for
  1 19 construction of erosion control structures and for other
  1 20 purposes specified in the bill for the purposes of the waste
  1 21 tire abatement program under the department of natural
  1 22 resources.  The bill also specifies that these products do not
  1 23 constitute solid waste.  The effect of these exclusions is to
  1 24 make inapplicable the prohibition against land disposal of
  1 25 these products and other limitations on transporting and
  1 26 disposal of these products which would otherwise apply to a
  1 27 waste tire.
