1 1 Section 1. Section 232.28, Code Supplement 1995, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 11. The intake officer shall notify the
1 4 superintendent of the school district or the superintendent's
1 5 designee, or the authorities in charge of a nonpublic school
1 6 which the child attends, of the filing of a complaint under
1 7 this section for an act which would be a violation of chapter
1 8 123, 124, or 321J, if committed by an adult, and of the filing
1 9 of a petition or dismissal of the complaint under this
1 10 section.
1 11 Sec. 2. Section 232.29, Code Supplement 1995, is amended
1 12 by adding the following new subsection:
1 13 NEW SUBSECTION. 3A. The person performing the duties of
1 14 intake officer shall notify the superintendent of the school
1 15 district or the superintendent's designee, or the authorities
1 16 in charge of the nonpublic school which the child attends, of
1 17 an informal adjustment regarding the child for an act which
1 18 would be a violation of chapter 123, 124, or 321J if committed
1 19 by an adult.
1 20 EXPLANATION
1 21 This bill provides that a juvenile intake officer must
1 22 notify school district officials or the authorities in charge
1 23 of a nonpublic school when a delinquency complaint is filed or
1 24 a juvenile receives an informal adjustment for a delinquent
1 25 act which would be a violation of chapter 123 (alcoholic
1 26 beverages), 124 (controlled substances), or 321J (operating
1 27 while intoxicated) if committed by an adult.
