1 1 Section 1. Section 372.4, unnumbered paragraph 3, Code
1 2 1995, is amended to read as follows:
1 3 The mayor shall appoint a council member as mayor pro tem,
1 4 and shall appoint and dismiss the marshal or chief of police
1 5 except where an intergovernmental agreement makes other
1 6 provisions for police protection or as otherwise provided in
1 7 section 400.13. However, the appointment and dismissal of the
1 8 marshal or chief of police are subject to the consent of a
1 9 majority of the council. Other officers must be selected as
1 10 directed by the council. The mayor is not a member of the
1 11 council and may not vote as a member of the council.
1 12 EXPLANATION
1 13 This bill provides that the marshal or chief of police of a
1 14 city with a mayor-council form of government and without civil
1 15 service or an intergovernmental agreement providing another
1 16 method of selection, shall be appointed and dismissed by the
1 17 mayor with the consent of a majority of the city council.
1 18 Under current law, the mayor of a city with a mayor-council
1 19 form and without civil service or an intergovernmental
1 20 agreement providing another method of selection, appoints the
1 21 marshal or chief of police without consent of the council.
