  1  1    Section 1.  Section 99B.5, subsection 1, paragraph a, Code
  1  2 1995, is amended to read as follows:
  1  3    a.  The raffle is conducted by the sponsor of the fair or a
  1  4 qualified organization licensed under section 99B.7 or a
  1  5 political subdivision of the state, that has received
  1  6 permission from the sponsor of the fair to conduct the raffle.
  1  7    Sec. 2.  Section 99B.5, subsection 1, paragraph b, Code
  1  8 1995, is amended to read as follows:
  1  9    b.  The sponsor of the fair or the qualified organization
  1 10 has submitted a license application and a fee of thirty
  1 11 dollars for each raffle, has been issued a license, and
  1 12 prominently displays the license at the drawing area of the
  1 13 raffle.  A political subdivision of this state is not required
  1 14 to pay a fee for a raffle license.
  1 15    Sec. 3.  Section 99B.5, subsection 1, paragraph g, Code
  1 16 1995, is amended to read as follows:
  1 17    g.  The actual retail value of any prize does not exceed
  1 18 fifty dollars.  If a prize consists of more than one item,
  1 19 unit, or part, the aggregate retail value of all items, units,
  1 20 or parts shall not exceed fifty dollars.  However, either a
  1 21 fair sponsor or a qualified organization, but not both, may
  1 22 hold one raffle per calendar year at which one or more prizes
  1 23 having a combined value not greater than twenty thousand of
  1 24 more than fifty dollars may be offered.  If the prize is
  1 25 merchandise, its value shall be determined by the purchase
  1 26 price paid by the fair sponsor, political subdivision, or
  1 27 qualified organization.
  1 28    Sec. 4.  Section 99B.5, subsection 1, Code 1995, is amended
  1 29 by adding the following new paragraph:
  1 30    NEW PARAGRAPH.  i.  An annual prize authorized under
  1 31 paragraph "g" may be cash, merchandise, or real property, or
  1 32 two or more of these items.
  1 33    Sec. 5.  Section 99B.7, subsection 1, paragraph d, Code
  1 34 1995, is amended to read as follows:
  1 35    d.  Cash prizes shall not be awarded in games other than
  2  1 bingo and raffles.  The value of a prize shall not exceed
  2  2 fifty dollars and merchandise prizes shall not be repurchased.
  2  3 If a prize consists of more than one item, unit, or part, the
  2  4 aggregate value of all items, units, or parts shall not exceed
  2  5 fifty dollars.  However, one raffle may be conducted per
  2  6 calendar year at which one or more prizes having a combined
  2  7 value not greater than twenty thousand of more than fifty
  2  8 dollars may be awarded.  If the prize is merchandise, its
  2  9 value shall be determined by purchase price paid by the
  2 10 organization, political subdivision, or donor.  Such an annual
  2 11 raffle prize may be cash, merchandise, or real property, or
  2 12 two or more of these items.
  2 13    Sec. 6.  Section 99B.7, subsection 1, Code 1995, is amended
  2 14 by adding the following new paragraph:
  2 15    NEW PARAGRAPH.  q.  A political subdivision of this state
  2 16 may conduct a raffle pursuant to this section in the same
  2 17 manner as a qualified organization.  However, a political
  2 18 subdivision of the state is not required to pay a license fee
  2 19 pursuant to subsection 3 and paragraph "m" does not apply to
  2 20 the political subdivision.  
  2 21                           EXPLANATION
  2 22    Under current law, the value of a raffle prize shall not
  2 23 exceed $50 and the price of a raffle ticket may not exceed $1.
  2 24 However, one raffle per year may have one or more prizes with
  2 25 a total value of not more than $20,000 and the raffle ticket
  2 26 price may exceed $1.
  2 27    This bill removes the restrictions on the value of a raffle
  2 28 prize.
  2 29    This bill also authorizes a political subdivision of this
  2 30 state to conduct a raffle in the same manner as a qualified
  2 31 organization.
  2 32    The raffle may also be conducted by the sponsor of a fair
  2 33 or by a qualified organization or a political subdivision of
  2 34 the state that has received permission from the sponsor of the
  2 35 fair.
