PAG LIN 1 1 Section 1. Section 92.19, unnumbered paragraphs 2, 3, and 1 2 4, Code 1995, are amended to read as follows: 1 3 No person shall willfully make, certify to, or cause to be 1 4 made or certified any statement, certificate, or other paper 1 5 for the purpose of procuring the employment of any person in 1 6 violation of this chapter or section 299.12. 1 7 No person shall make, file, execute, or deliver any 1 8 statement, certificate, or other paper containing false 1 9 statements for the purpose of procuring employment of any 1 10 person in violation of this chapter or section 299.12. 1 11 No person, firm, or corporation, or any agent thereof shall 1 12 willfully conceal or permit a person to be employed in 1 13 violation of this chapter or section 299.12. 1 14 Sec. 2. Section 299.6, unnumbered paragraph 1, Code 1995, 1 15 is amended to read as follows: 1 16 Any person who violates a mediation agreement under section 1 17 299.5A, who is referred for prosecution under section 299.5A 1 18 and is convicted of a violation of any of the provisions of 1 19 sections 299.1 through 299.5, who violates any of the 1 20 provisions of sections 299.1 through 299.5, who employs a 1 21 child in violation of section 299.12, or who refuses to 1 22 participate in mediation under section 299.5A, for a first 1 23 offense, is guilty of a simple misdemeanor. 1 24 Sec. 3. NEW SECTION. 299.12 EMPLOYMENT OF TRUANT DURING 1 25 SCHOOL DAY PROHIBITED. 1 26 A person having custody or control of a child of compulsory 1 27 school age shall not knowingly employ the child or allow the 1 28 child to be employed, with or without consideration, during 1 29 the hours of the school day in which the child is required to 1 30 attend school as provided in this chapter. 1 31 EXPLANATION 1 32 This bill provides that a person having custody or control 1 33 of a child of compulsory school age who knowingly employs the 1 34 child or allows the child to be employed, with or without 1 35 consideration, during the hours of the school day in which the 2 1 child is required to attend school is guilty of a simple 2 2 misdemeanor. The same penalty is also applied to a person who 2 3 willfully makes, certifies to, or causes to be made or 2 4 certified any statement, certificate, or other paper for the 2 5 purpose of procuring the employment of the child; to a person 2 6 who makes, files, executes, or delivers any statement, 2 7 certificate, or other paper containing false statements for 2 8 the purpose of procuring employment of the child; and to a 2 9 person, firm, or corporation, or any agent who willfully 2 10 conceals or permits a child to be employed in violation of 2 11 this provision. 2 12 LSB 2457YH 76 2 13 kh/jj/8
