  1  1    Section 1.  Section 99F.7, subsection 10, paragraph a, Code
  1  2 1995, is amended to read as follows:
  1  3    a.  A license to conduct gambling games on an excursion
  1  4 gambling boat in a county shall be issued only if the county
  1  5 electorate approves the conduct of the gambling games as
  1  6 provided in this subsection.  The board of supervisors, upon
  1  7 receipt of a valid petition meeting the requirements of
  1  8 section 331.306, shall direct the commissioner of elections to
  1  9 submit to the qualified electors of the county a proposition
  1 10 to approve or disapprove the conduct of gambling games on an
  1 11 excursion gambling boat in the county.  The proposition shall
  1 12 be submitted at a general election or at a special election
  1 13 called for that purpose.  To be submitted at a general
  1 14 election, the petition must be received by the board of
  1 15 supervisors at least five working days before the last day for
  1 16 candidates for county offices to file nomination papers for
  1 17 the general election pursuant to section 44.4.  If a majority
  1 18 of the county voters voting on the proposition favor the
  1 19 conduct of gambling games, the commission may issue one or
  1 20 more licenses as provided in this chapter.  If a majority of
  1 21 the county voters voting on the proposition do not favor the
  1 22 conduct of gambling games, a license to conduct gambling games
  1 23 in the county shall not be issued.  After a referendum has
  1 24 been held, another referendum requested by petition shall not
  1 25 be held for at least two years.
  1 26    Sec. 2.  Section 99F.7, subsection 10, Code 1995, is
  1 27 amended by adding the following new paragraph:
  1 28    NEW PARAGRAPH.  d.  After a referendum has been held which
  1 29 defeated a proposal to conduct gambling games on excursion
  1 30 gambling boats or which defeated a proposal to conduct
  1 31 gambling games at a licensed pari-mutuel racetrack enclosure
  1 32 as provided in this section, another referendum on a proposal
  1 33 to conduct gambling games on an excursion gambling boat or at
  1 34 a licensed pari-mutuel racetrack shall not be held for at
  1 35 least two years.
  2  1    Sec. 3.  EFFECTIVE DATE AND RETROACTIVE APPLICABILITY.
  2  2 This Act, being deemed of immediate importance, takes effect
  2  3 upon enactment and applies retroactively to September 1, 1994.  
  2  4                           EXPLANATION
  2  5    This bill provides that if a proposal to conduct gambling
  2  6 games on excursion gambling boats or to conduct gambling games
  2  7 at a licensed pari-mutuel racetrack is defeated at a
  2  8 referendum, a proposal to conduct gambling games on an
  2  9 excursion gambling boat or at a licensed pari-mutuel racetrack
  2 10 shall not be submitted to the electorate again for at least
  2 11 two years.
  2 12    This bill applies retroactively to September 1, 1994.
