  1  1    Section 1.  Section 321.1, subsection 32, paragraph f, Code
  1  2 1995, is amended to read as follows:
  1  3    f.  Self-propelled machinery or machinery towed by a motor
  1  4 vehicle or farm tractor operated at speeds of less than thirty
  1  5 miles per hour.  The machinery must be specifically designed
  1  6 for, or especially adapted to be capable of, incidental over-
  1  7 the-road and primary off-road usage.  In addition, the
  1  8 machinery must be used exclusively for the mixing and
  1  9 dispensing of nutrients to bovine animals fed at a feedlot, or
  1 10 the application of organic or inorganic plant food materials,
  1 11 agricultural limestone, or agricultural chemicals.  However,
  1 12 the machinery shall not be specifically designed or intended
  1 13 for the transportation of such nutrients, plant food
  1 14 materials, agricultural limestone, or agricultural chemicals.
  1 15 The machinery shall be operated in compliance with section
  1 16 321.463.  
  1 17                           EXPLANATION
  1 18    This bill provides that machinery drawn by a motor vehicle
  1 19 or farm tractor and used for mixing or dispensing feed or the
  1 20 application of plant food materials is considered an implement
  1 21 of husbandry.  The bill further provides that the plant food
  1 22 materials may be either organic or inorganic.
  1 23    This bill also provides that certain self-propelled
  1 24 machinery, as well as the machinery added by this bill,
  1 25 defined as an implement of husbandry is not specifically
  1 26 subject to the gross weight restrictions provided in section
  1 27 321.463.  Instead, the machinery is treated similarly to other
  1 28 equipment deemed an implement of husbandry and subject to the
  1 29 exceptions to size, weight, and load requirements as provided
  1 30 in section 321.453.
