1 1 Section 1. Section 455D.3, subsection 3, paragraph a,
1 2 unnumbered paragraph 3, Code 1995, is amended to read as
1 3 follows:
1 4 If the department determines that a planning area has
1 5 failed to meet the July 1, 1994, twenty-five percent goal, the
1 6 planning area shall, at a minimum, implement the solid waste
1 7 management techniques as listed in subsection 4. However, the
1 8 department shall consider the actual tonnage of waste that was
1 9 diverted from the planning area's waste stream in determining
1 10 whether the planning area has met the twenty-five percent
1 11 goal. Evidence of implementation of the solid waste
1 12 management techniques shall be documented in subsequent
1 13 comprehensive plans submitted to the department.
1 14 EXPLANATION
1 15 This bill amends section 455D.3 to require the department
1 16 of natural resources to consider the actual tonnage of waste
1 17 that was diverted from a planning area's waste stream in
1 18 determining whether the planning area has met the 25 percent
1 19 waste reduction and recycling goal.
