PAG LIN 1 1 Section 1. Section 633.557, Code 1995, is amended to read 1 2 as follows: 1 3 633.557 APPOINTMENT OF GUARDIAN ON VOLUNTARY PETITION. 1 4 A guardian may also be appointed by the court upon the 1 5 verified petition of the proposed ward, without further 1 6 notice, if the proposed ward isother than a minor under the1 7age of fourteen yearsan adult, a minor age fourteen years or 1 8 older, or a minor under the age of fourteen years if the court 1 9 determines the minor to be mature and capable of providing 1 10 informed consent, provided the court determines that such an 1 11 appointment will inure to the best interest of the applicant. 1 12 However, if an involuntary petition is pending, the court 1 13 shall be governed by section 633.634. The petition shall 1 14 provide the proposed ward notice of a guardian's powers as 1 15 provided in section 633.562. 1 16 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 17 immediate importance, takes effect upon enactment. 1 18 EXPLANATION 1 19 This bill provides that a person under 14 years of age may 1 20 have a guardian appointed for the person on a voluntary 1 21 petition if the court determines that the person is mature 1 22 enough to provide informed consent to the appointment.
