1 1 Section 1. NEW SECTION. 668.10A EXEMPTION FOR OWNERS OR
1 2 POSSESSORS OF REAL PROPERTY.
1 3 A person who owns or possesses real property shall not be
1 4 found at fault under this chapter for injuries occurring on
1 5 the real property under the following circumstances:
1 6 1. Where the person has given the plaintiff or the person
1 7 on behalf of whom the plaintiff is bringing the action
1 8 permission to be on the real property.
1 9 2. Where the plaintiff or person on behalf of whom the
1 10 plaintiff is bringing the action was present on the real
1 11 property without the owner's or possessor's permission for an
1 12 otherwise lawful recreational purpose.
1 13 EXPLANATION
1 14 This bill exempts owners or persons possessing real
1 15 property from tort liability for injuries occurring to a
1 16 person who had permission from the owner or person in
1 17 possession to be on the property or a person who was present
1 18 on the property without the owner's permission for an
1 19 otherwise lawful purpose.
