1 1 Section 1. Section 598.41, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 7. The supreme court shall prescribe
1 4 rules to provide for the form of a notice which shall be
1 5 attached to all temporary and permanent orders which are
1 6 modified and result in the change of custody of a child named
1 7 in the order. The notice shall be written in clear,
1 8 understandable language and shall include, but is not limited
1 9 to, a statement that the order which modifies custody does not
1 10 necessarily modify a support obligation and that a separate
1 11 modification action may be necessary to effect a support
1 12 obligation.
1 13 EXPLANATION
1 14 This bill requires the supreme court to prescribe rules to
1 15 provide for the form of a notice to be attached to temporary
1 16 or permanent child custody modification orders. The notice is
1 17 to be written in clear, understandable language and is to
1 18 include a statement that the modification of custody order
1 19 does not necessarily modify a child support obligation and
1 20 that a separate modification action may be necessary.
