1 1 Section 1. Section 352.7, subsection 2, Code 1995, is
1 2 amended to read as follows:
1 3 2. Within sixty days after receipt, the county board shall
1 4 adopt the proposal or any modification of the proposal it
1 5 deems appropriate, or reject the proposal, unless to do so
1 6 would be inconsistent with the purposes of this chapter.
1 7 Rejection of the proposal shall be based on one or more of the
1 8 following criteria:
1 9 a. The proposal poses a serious environmental threat.
1 10 b. The proposal poses a definite public health threat.
1 11 c. The proposal poses a significant detrimental impact on
1 12 the values of residential property adjoining the proposed
1 13 agricultural area.
1 14 EXPLANATION
1 15 This bill provides that a county board of supervisors shall
1 16 reject the creation or expansion of an agricultural area if
1 17 the proposal poses a serious environmental hazard, a definite
1 18 public health threat, or a significant detrimental impact on
1 19 residential property values on property adjoining an
1 20 agricultural area.
