PAG LIN 1 1 Section 1. Section 331.441, subsection 2, paragraph b, 1 2 subparagraph (12), Code 1995, is amended by striking the 1 3 subparagraph. 1 4 Sec. 2. Section 331.441, subsection 2, paragraph c, Code 1 5 1995, is amended by adding the following new subparagraph: 1 6 NEW SUBPARAGRAPH. (12) Funding the acquisition, 1 7 construction, reconstruction, improvement, repair, or 1 8 equipping of waterworks, water mains and extensions, ponds, 1 9 reservoirs, capacity, wells, dams, pumping installations, real 1 10 and personal property, or other facilities available or used 1 11 for the storage, transportation, or utilization of water. 1 12 (a) The county board of supervisors may on its own motion 1 13 or upon a written petition of a water supplier established 1 14 under chapter 357A or 504A, direct the county auditor to 1 15 establish a special service area tax district for the purpose 1 16 of issuing general obligation bonds. The special service area 1 17 tax district shall include only unincorporated portions of the 1 18 county and shall be drawn according to engineering 1 19 recommendations provided by the water supplier or the county 1 20 engineer and, in addition, shall be drawn in order that an 1 21 election provided for in subparagraph subdivision (b) can be 1 22 administered. The county's debt service tax levy for the 1 23 county general obligation bonds issued for the purposes set 1 24 out in this subparagraph shall be levied only against taxable 1 25 property within the county which is included within the 1 26 boundaries of the special service area tax district. An owner 1 27 of property not included within the boundaries of the special 1 28 service area tax district may petition the board of 1 29 supervisors to be included in the special service area tax 1 30 district subsequent to its establishment. 1 31 (b) General obligation bonds for the purposes described in 1 32 this subparagraph are subject to an election held in the 1 33 manner provided in section 331.442, subsections 1 through 4, 1 34 if not later than fifteen days following the action by the 1 35 county board of supervisors, eligible voters file a petition 2 1 with the county commissioner of elections asking that the 2 2 question of issuing the bonds be submitted to the qualified 2 3 electors of the special service area tax district. The 2 4 petition must be signed by at least five percent of the 2 5 registered voters residing in the special service area tax 2 6 district. If the petition is duly filed within the fifteen 2 7 days, the board of supervisors shall either adopt a resolution 2 8 declaring that the proposal to issue the bonds is abandoned, 2 9 or direct the county commissioner of elections to call a 2 10 special election within a special service area tax district 2 11 upon the question of issuing the bonds. 2 12 EXPLANATION 2 13 This bill changes the funding of the acquisition, 2 14 construction, improvement, repair, or equipping of waterworks, 2 15 water mains and extension, ponds, reservoirs, capacity, wells, 2 16 dams, pumping installations, and related facilities from 2 17 essential county purpose general obligation bonds to general 2 18 county purpose general obligation bonds. 2 19 LSB 1552HH 76 2 20 tj/sc/14
