PAG LIN 1 1 Section 1. Section 257.8, subsection 1, Code 1995, is 1 2 amended to read as follows: 1 3 1. STATE PERCENT OF GROWTH. The state percent of growth 1 4 for a budget year shall be established by statute which shall 1 5 be enacted within thirty days of the submission in the base 1 6 year of the governor's budget under section 8.21. The 1 7 establishment of the state percent of growth for a budget year 1 8 shall be the only subject matter of the bill which enacts the 1 9 state percent of growth for a budget year. Notwithstanding 1 10 section 2.10, or any other provision to the contrary, if on 1 11 the thirtieth day after the submission of the governor's 1 12 budget, the general assembly fails to enact the statute as 1 13 provided in this subsection, the members of the general 1 14 assembly shall forfeit salary, per diem, and expenses earned 1 15 or to which they are entitled as legislators. The department 1 16 of revenue and finance, in cooperation with the secretary of 1 17 the senate and the chief clerk of the house of 1 18 representatives, shall reduce each member's salary payment for 1 19 each day for which the general assembly fails to enact the 1 20 statute as provided in this subsection, by an amount equal to 1 21 the member's annual salary divided by three hundred sixty- 1 22 five. Payment of per diem and expenses to members of the 1 23 general assembly shall resume on the date on which the statute 1 24 provided for in this subsection is enacted. 1 25 EXPLANATION 1 26 This bill provides that members of the general assembly 1 27 will forfeit salary, per diem, and expense payments if the 1 28 deadline for enactment of the allowable growth statute is not 1 29 met. 1 30 Current law provides that the general assembly must enact a 1 31 statute establishing the state percent of growth for a budget 1 32 year within 30 days of the submission in the base year of the 1 33 governor's budget. The bill directs the department of revenue 1 34 and finance, in consultation with the secretary of the senate 1 35 and the chief clerk of the house, to reduce each member's 2 1 salary payment for each day for which the general assembly 2 2 fails to enact the statute, by an amount equal to the member's 2 3 annual salary divided by 365. Payment of per diem and 2 4 expenses to members of the general assembly shall resume on 2 5 the date on which the statute provided for in this subsection 2 6 is enacted. 2 7 LSB 2213HH 76 2 8 kh/jj/8
