  1  1    Section 1.  Section 257.2, subsection 12, Code 1995, is
  1  2 amended to read as follows:
  1  3    12.  "State percent of growth" means the percent of growth
  1  4 which is established by statute pursuant to section 257.8, and
  1  5 which is used in determining the allowable growth.
  1  6    Sec. 2.  Section 257.8, subsection 1, Code 1995, is amended
  1  7 to read as follows:
  1  8    1.  STATE PERCENT OF GROWTH.  The state percent of growth
  1  9 for a budget year shall be established by statute which shall
  1 10 be enacted within thirty days of the submission in the base
  1 11 year of the governor's budget under section 8.21.  The
  1 12 establishment of the state percent of growth for a budget year
  1 13 shall be the only subject matter of the bill which enacts the
  1 14 state percent of growth for a budget year.  However, if a
  1 15 statute to establish the state percent of growth is not
  1 16 enacted within thirty days following submission of the
  1 17 governor's budget, the state percent of growth is established
  1 18 at one percent for the budget year.
  1 19    Sec. 3.  This Act, being deemed of immediate importance,
  1 20 takes effect upon enactment and applies to establishing the
  1 21 state percent of growth for school budget years beginning
  1 22 after the effective date of this Act.  
  1 23                           EXPLANATION
  1 24    Present law requires that within 30 days of the governor's
  1 25 submission of the budget to the general assembly, a statute
  1 26 must be enacted that establishes the state percent of growth
  1 27 for the school budget year beginning the following July 1.
  1 28 This bill provides that if the statute is not enacted within
  1 29 the 30 days, the state percent of growth will automatically be
  1 30 set at 1 percent.
  1 31    The bill takes effect upon enactment and applies with the
  1 32 budget year beginning after the effective date.
