1 1 Section 1. NEW SECTION. 159.35 CHRISTMAS TREES.
1 2 1. As used in this section, unless the context otherwise
1 3 requires, "Christmas tree" means a tree classified as a
1 4 conifer with persistent needles, that is sold to consumers on
1 5 a retail basis for use in celebrating or observing Christmas.
1 6 2. A precut Christmas tree shall not be sold in this state
1 7 on and after November 15 but before December 25 of each year,
1 8 unless a label containing information naming the state where
1 9 the Christmas tree was harvested is affixed to the tree. If
1 10 the Christmas tree is harvested in a nation other than the
1 11 United States, the label shall contain information stating the
1 12 nation where the Christmas tree was harvested.
1 13 3. The department shall adopt rules under chapter 17A
1 14 providing for standards relating to the preparation of labels
1 15 and information contained on the labels required in this
1 16 section.
1 17 4. A violation of this section or a rule adopted by the
1 18 department pursuant to this section is a violation of section
1 19 714.16. The remedies and penalties provided by section
1 20 714.16, including but not limited to provisions relating to
1 21 injunctive relief and penalties, apply to violations of this
1 22 section.
1 23 EXPLANATION
1 24 This bill regulates the sales of Christmas trees, which are
1 25 defined as a conifer with persistent needles, that is sold to
1 26 consumers on a retail basis for use in celebrating or
1 27 observing Christmas. The bill provides that a precut
1 28 Christmas tree shall not be sold in this state on and after
1 29 November 15 but before December 25 of each year, unless the
1 30 tree is affixed with a label containing information naming the
1 31 state where the Christmas tree was harvested. The bill
1 32 provides that if a Christmas tree is harvested in a nation
1 33 other than the United States, the label must contain
1 34 information stating the nation where the Christmas tree was
1 35 harvested. The department must adopt rules providing for
2 1 standards relating to the preparation of labels and
2 2 information contained on the labels as required in this
2 3 section. A violation of the bill or a rule adopted by the
2 4 department is a violation of section 714.16. The remedies and
2 5 penalties provided by section 714.16, including but not
2 6 limited to provisions relating to injunctive relief and
2 7 penalties, apply to violations of the bill.
