PAG LIN 1 1 Section 1. Section 135.24, Code 1995, is amended to read 1 2 as follows: 1 3 135.24 VOLUNTEERPHYSICIANHEALTH CARE PROVIDER PROGRAM 1 4 ESTABLISHED &endash; IMMUNITY FROM CIVIL LIABILITY. 1 5 1. The director shall establish within the department a 1 6 program to provide to eligible hospitals, clinics, or other 1 7 health care facilities,orhealth care referral programs, or 1 8 charitable organizations, free medical services given on a 1 9 voluntary basis byphysicians licensed under chapter 148, 150,1 10or 150Ahealth care providers. A participatingphysician1 11 health care provider shall register with the department and 1 12 obtain from the department a list of eligible, participating 1 13 hospitals, clinics, or other health care facilities,orhealth 1 14 care referral programs, or charitable organizations. 1 15 2. The department, in consultation with the department of 1 16 human services, shall adopt rules to implement the volunteer 1 17physicianhealth care provider program which shall include the 1 18 following: 1 19 a. Procedures for registration ofphysicianshealth care 1 20 providers deemed qualified by the board of medical examiners, 1 21 the board of physician assistant examiners, and the board of 1 22 nursing. 1 23 b. Criteria for and identification of hospitals, clinics, 1 24 or other health care facilities,orhealth care referral 1 25 programs, or charitable organizations, eligible to participate 1 26 in the provision of free medical services through the 1 27 volunteerphysicianhealth care provider program. A health 1 28 care facility, a health care referral program, a charitable 1 29 organization, or a health care provider participating in the 1 30 program shall not bill or charge a patient for anyphysician1 31 health care provider service provided under the volunteer 1 32physicianhealth care provider program. 1 33 3. Aphysicianhealth care provider providing free care 1 34 under this section shall be considered an employee of the 1 35 state under chapter 669 and shall be afforded protection as an 2 1 employee of the state under section 669.21, provided that the 2 2physicianhealth care provider has done all of the following: 2 3 a. Registered with the department pursuant to subsection 2 4 1. 2 5 b. Provided medical services through a hospital, clinic, 2 6 or other health care facility,orhealth care referral 2 7 program, or charitable organization listed as eligible and 2 8 participating by the department pursuant to subsection 1. 2 9 4. For the purposes of this section, "health care 2 10 provider" means a physician licensed under chapter 148, 150, 2 11 or 150A, a physician assistant licensed and practicing under a 2 12 supervising physician pursuant to chapter 148C, a licensed 2 13 practical nurse, or a registered nurse. 2 14 5. For the purposes of this section, "charitable 2 15 organization" means a charitable organization within the 2 16 meaning of section 501(c)(3) of the Internal Revenue Code 2 17 which has as its primary purpose the sponsorship or support of 2 18 programs designed to improve the quality, awareness, and 2 19 availability of medical services to children and to serve as a 2 20 funding mechanism for provision of medical services, including 2 21 but not limited to immunizations, to children in this state. 2 22 HF 197 2 23 pf/pk/25
