1 1 Section 1. Section 598.21, subsection 4, paragraph a,
1 2 unnumbered paragraph 1, Code 1995, is amended to read as
1 3 follows:
1 4 Upon every judgment of annulment, dissolution, or separate
1 5 maintenance, the court may order either parent or both parents
1 6 to pay an amount reasonable and necessary for supporting a
1 7 child. In establishing the amount of support, consideration
1 8 shall be given to the responsibility of both parents to
1 9 support and provide for the welfare of the minor child and of
1 10 a child's need, whenever practicable, for a close relationship
1 11 with both parents. There shall be a rebuttable presumption
1 12 that the amount of child support which would result from the
1 13 application of the guidelines prescribed by the supreme court
1 14 is the correct amount of child support to be awarded. A
1 15 variation from the guidelines shall not be considered by a
1 16 court without a record or written finding, based on stated
1 17 reasons, that the guidelines would be unjust or inappropriate
1 18 as determined under the criteria prescribed by the supreme
1 19 court. In determining support for a child relating to payment
1 20 of postsecondary education expenses, the court shall require
1 21 that, if support for these expenses is ordered, both parents
1 22 contribute in an equal manner.
1 23 EXPLANATION
1 24 This bill provides that if support for a child relating to
1 25 payment of postsecondary education expenses is ordered in a
1 26 judgment of annulment, dissolution, or separate maintenance,
1 27 both parents are to contribute in an equal manner.
