1 1 Section 1. Section 97B.39, Code 1995, is amended to read
1 2 as follows:
1 3 97B.39 RIGHTS NOT TRANSFERABLE &endash; NOT SUBJECT TO LEGAL
1 4 PROCESS.
1 5 The right of any person to any future payment under this
1 6 chapter is not transferable or assignable, at law or in
1 7 equity, and the moneys paid or payable or rights existing
1 8 under this chapter are not subject to execution, levy,
1 9 attachment, garnishment, or other legal process, or to the
1 10 operation of any bankruptcy or insolvency law, except for the
1 11 purposes of enforcing child, spousal, or medical support
1 12 obligations or in accordance with qualified domestic relations
1 13 orders. For the purposes of enforcing child, spousal, or
1 14 medical support obligations, the garnishment or attachment of
1 15 or the execution against compensation due a person under
1 16 chapter 97B shall not exceed the amount specified in 15 U.S.C.
1 17 } 1673(b).
1 18 EXPLANATION
1 19 This bill provides that the Iowa public employees'
1 20 retirement system is required to pay benefits in accordance
1 21 with qualified domestic relations orders regarding the
1 22 division of retirement pension funds between parties to a
1 23 dissolution of marriage order.
