1 1 Section 1. NEW SECTION. 514C.8 SERVICES PROVIDED BY
1 2 LICENSED PHYSICIAN ASSISTANTS.
1 3 A policy, contract, or plan providing for third-party
1 4 payment or prepayment of health or medical expenses shall
1 5 include a provision for the payment of necessary medical or
1 6 surgical care and treatment provided by a physician assistant
1 7 licensed pursuant to chapters 147 and 148C, if performed
1 8 within the scope of the licensed physician assistant's license
1 9 and the policy, contract, or plan would pay for the care and
1 10 treatment if the care and treatment were provided by a person
1 11 engaged in the practice of medicine or surgery as licensed
1 12 under chapter 148 or 150A. The policy, contract, or plan
1 13 shall provide that insureds or enrollees under the policy,
1 14 contract, or plan may reject the coverage for services which
1 15 may be provided by a licensed physician assistant if the
1 16 coverage is rejected for all providers of similar services.
1 17 The terms and conditions under which physician assistant
1 18 services are compensated shall not contain practice or
1 19 supervision restrictions in addition to those already imposed
1 20 by law. This section applies to services provided under a
1 21 policy, contract, or plan issued on or after July 1, 1995, and
1 22 to an existing group policy, contract, or plan on the
1 23 anniversary or renewal date of the existing group policy,
1 24 contract, or plan, or upon the expiration of the applicable
1 25 collective bargaining contract, if any, whichever is later.
1 26 Notwithstanding section 514C.6, this section does not apply to
1 27 enrollees eligible for coverage under Title XVIII of the
1 28 Social Security Act or any other similar coverage under a
1 29 state or federal government plan.
1 30 EXPLANATION
1 31 This bill requires insurance companies and other third-
1 32 party payors to provide reimbursement for services provided by
1 33 a licensed physician assistant if reimbursement for such
1 34 services would be provided by a person engaged in the practice
1 35 of medicine or surgery as licensed under chapter 148 or 150A.
