  1  1    Section 1.  Section 20.22, subsection 9, paragraph c, Code
  1  2 1995, is amended to read as follows:
  1  3    c.  The interests and welfare of the public, the ability of
  1  4 the public employer to finance pay for any economic
  1  5 adjustments and the effect of such payment of any economic
  1  6 adjustments on the normal standard of services financial
  1  7 position of the public employer including the public
  1  8 employer's ability to provide other necessary services.
  1  9    Sec. 2.  Section 20.22, subsection 9, paragraph d, Code
  1 10 1995, is amended by striking the paragraph.  
  1 11                           EXPLANATION
  1 12    The bill provides that an arbitrator in binding arbitration
  1 13 shall consider the effect of any award on the public
  1 14 employer's overall financial position and its ability to
  1 15 provide other necessary services.  The bill also eliminates as
  1 16 a required factor for consideration by an arbitrator the power
  1 17 of the employer to levy taxes and appropriate funds.
