1 1 Section 1. PRIVATIZATION MORATORIUM. From July 1, 1995,
1 2 until June 30, 1997, the state shall not enter into any new
1 3 contract or agreement for the purpose of performing a state
1 4 function if that function is currently being performed by the
1 5 state through state employees, as defined by section 68B.2.
1 6 Sec. 2. PRIVATIZATION STUDY COMMITTEE. A committee to
1 7 study future privatization efforts shall be formed, consisting
1 8 of the director of the department of management, the auditor
1 9 of state, and the attorney general, or their designees. The
1 10 committee shall study and propose selection criteria for
1 11 future privatization efforts, a process for evaluating cost
1 12 savings from privatization, a process for establishing bidding
1 13 criteria, a method for monitoring and evaluating privatization
1 14 efforts, and any other recommendation concerning privatization
1 15 efforts. The committee shall report its findings and
1 16 recommendations to the general assembly by January 13, 1997.
1 17 EXPLANATION
1 18 This bill creates a two-year moratorium, from July 1, 1995,
1 19 to June 30, 1997, on future privatization efforts by the
1 20 state. The bill also creates a privatization study committee,
1 21 consisting of the director of the department of management,
1 22 the auditor of state, and the attorney general, or their
1 23 designees. The committee is to study various aspects of
1 24 privatization, including adoption of any uniform guidelines
1 25 concerning privatization, and to report the committee's
1 26 findings and recommendations to the general assembly by
1 27 January 13, 1997.
