1 1 HOUSE CONCURRENT RESOLUTION NO.
1 2 BY SHOULTZ
1 3 A Concurrent Resolution requesting that the Legislative
1 4 Council appoint an interim study committee relating
1 5 to family law issues.
1 6 WHEREAS, many socioeconomic factors place increased
1 7 stress on the family; and
1 8 WHEREAS, these stresses have resulted in increased
1 9 single-parent homes, child and domestic abuse,
1 10 poverty, and violence; and
1 11 WHEREAS, nearly 50 percent of children today will
1 12 spend a portion of their childhood living in a single-
1 13 parent home; and
1 14 WHEREAS, the family income of those living in
1 15 single-parent homes has declined when compared with
1 16 the family income of those living in two-parent homes,
1 17 resulting in an increased number of children and
1 18 families living in poverty; and
1 19 WHEREAS, the issues involved in family
1 20 relationships, including paternity, custody,
1 21 visitation, and support of children, the rights and
1 22 responsibilities of parents vis-a-vis their children,
1 23 and financial responsibilities between domestic
1 24 partners, result in a complex family law system; and
1 25 WHEREAS, the family law system, in addressing these
1 26 issues, utilizes an adversarial process which may
1 27 exacerbate any conflict which exists between the
1 28 parties, resulting in harmful effects to the parties
1 29 and to any children involved; NOW THEREFORE,
1 30 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
2 1 SENATE CONCURRING, That the Legislative Council is
2 2 requested to appoint a study committee during the 1996
2 3 legislative interim to review and make recommendations
2 4 regarding the family law system, including but not
2 5 limited to issues relating to dissolution of marriage,
2 6 child custody, visitation, and support, termination of
2 7 parental rights, and domestic abuse, and to submit a
2 8 report to the General Assembly on or before December
2 9 15, 1996.
