1 4 A Concurrent Resolution relating to border city truck-
1 5 ing agreements.
1 6 WHEREAS, in the early 1970s the states of Iowa,
1 7 Nebraska, and South Dakota developed border city
1 8 agreements which allowed for the free flow of trade
1 9 among the states; and
1 10 WHEREAS, these compacts allowed farmers, truckers,
1 11 and other business people to cross state boundaries;
1 12 and
1 13 WHEREAS, federal regulations have required states
1 14 to prohibit divisible loads with a gross weight in
1 15 excess of 80,000 pounds on interstate highways; and
1 16 WHEREAS, states were allowed grandfather rights if
1 17 the state had authorized heavier loads or had issued
1 18 overweight permits for divisible loads in effect on
1 19 July 1, 1956; and
1 20 WHEREAS, Iowa did not allow heavier loads or issue
1 21 overweight permits as of July 1, 1956, and therefore
1 22 is not eligible for grandfather rights; and
1 23 WHEREAS, the federal Highway Administration will
1 24 not allow Iowa to change its laws without imposition
1 25 of sanctions; and
1 26 WHEREAS, the states of Nebraska and South Dakota
1 27 have grandfather provisions which allow the use of
1 28 divisible loads in excess of 80,000 pounds; and
1 29 WHEREAS, one example of the problem is the movement
1 30 of livestock into the Sioux City stockyards from
2 1 Nebraska and South Dakota in trailers which exceed
2 2 Iowa's legal gross weight of 80,000 pounds, although
2 3 the vehicles are otherwise within legal requirements
2 4 per axle; and
2 5 WHEREAS, because such vehicles are not legal in
2 6 Iowa, farmers are forced to lighten their loads or
2 7 truck their livestock to terminals farther away; and
2 8 WHEREAS, this increases costs, reduces profits, and
2 9 adversely affects border city stockyards; and
2 10 WHEREAS, the Secretary of the United States
2 11 Department of Transportation, Federico Pena, has
2 12 stated that he does not have the authority to grant
2 13 Iowa a waiver from the federal regulations; NOW
2 14 THEREFORE,
2 15 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
2 16 SENATE CONCURRING, That the Iowa General Assembly
2 17 requests that a federal waiver be authorized to allow
2 18 the state of Iowa to update the border city agreement
2 19 so that trucks may enter Iowa's western boundaries to
2 20 load and unload without violating Iowa's weight
2 21 restrictions; and
2 22 BE IT FURTHER RESOLVED, That copies of this
2 23 resolution be sent to the President of the United
2 24 States Senate, the Speaker of the United States House
2 25 of Representatives, and to members of Iowa's
2 26 congressional delegation.
