1 11 A Concurrent Resolution to request that Congress
1 12 propose a Constitutional amendment, for ratifi-
1 13 cation by the states, which would specify that
1 14 the Congress and the states have the power to
1 15 prohibit the physical desecration of the American
1 16 flag.
1 17 WHEREAS, although the right of free expression is
1 18 part of the foundation of the United States
1 19 Constitution, very carefully drawn limits on
1 20 expression in specific instances have long been
1 21 recognized as legitimate means of maintaining public
1 22 safety and defining other societal standards; and
1 23 WHEREAS, certain actions, although arguably related
1 24 to one person's free expression, nevertheless raise
1 25 issues concerning public decency, public peace, and
1 26 the rights of other citizens; and
1 27 WHEREAS, there are symbols of our national soul,
1 28 such as the Washington Monument, the United States
1 29 Capitol Building, and memorials to our greatest
1 30 leaders, which are the property of every American and
2 1 are worthy of protection from desecration and
2 2 dishonor; and
2 3 WHEREAS, the American flag is a most honorable and
2 4 worthy banner that is a symbol of a nation which is
2 5 thankful for its strengths and is committed to curing
2 6 its faults, a nation that remains the destination of
2 7 millions of immigrants attracted by the universal
2 8 power of the American ideal; and
2 9 WHEREAS, the Constitution, as interpreted by the
2 10 United States Supreme Court, no longer accords the
2 11 Stars and Stripes the reverence, respect, and dignity
2 12 befitting the banner of this most noble experiment of
2 13 a nation-state; and
2 14 WHEREAS, it is only fitting that people everywhere
2 15 should lend their voices to a forceful call for
2 16 restoration of the Stars and Stripes to a proper
2 17 station under law and decency; NOW THEREFORE,
2 18 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
2 19 SENATE CONCURRING, That the General Assembly of the
2 20 State of Iowa respectfully requests that the Congress
2 21 of the United States propose an amendment to the
2 22 United States Constitution, to be ratified by the
2 23 states, that specifies that Congress and the states
2 24 have the power to prohibit the physical desecration of
2 25 the flag of the United States; and
2 26 BE IT FURTHER RESOLVED, That copies of this
2 27 Resolution be transmitted to the Speaker of the United
2 28 States House of Representatives, the President of the
2 29 United States Senate, and all of the members of Iowa's
2 30 congressional delegation.
